Pet Ownership & Fees - this topic is truly done and dusted. However, for those still facing resistance from their strata committees regarding pets, here are key points to reference:

1. Legal Basis: Pets cannot be arbitrarily restricted. This matter has been definitively addressed by the Highest Court in the state of NSW. The legislation has also been updated to reflect this judgment, and it has been reaffirmed in the latest round of strata reforms in December 2023.

2. Bond or Fee Requirement: Importantly, a bond or fee cannot be required for approvals on pet ownership. Despite persistent attempts by committees to be creative in justifying this, it contradicts the established legal framework.

3. Administrative Burden: In our Supreme Court case, we responded to my committee's claim of potential administrative burden. Some of our responses can serve as a reference for you. Committees may argue administrative burden as a reason for not approving pets. However, it's crucial to clarify that they are not obligated to approve pets; they can simply request a registration form with your pet's details. In our specific circumstances, with a building manager and a strata manager in place, administrative burden is not a valid claim. Owners Corporations routinely handle approvals for various matters such as renovations, maintenance, and general building operations. Approving pets is no more burdensome than these routine responsibilities.

4. Dealing with Persistence: If the committee persists in their opposition, my advice is to stand firm. This issue has been extensively addressed, and their arguments lack substance. It's time to move beyond this prolonged debate.

The Cooper Case, the case that keeps on giving and I couldn’t be prouder, here’s to Angus ❤

Following the landmark decision in the Cooper v The Owners – Strata Plan No. 58068 [2020] NSWCA 250 (“Cooper”) case, where the Court of Appeal ruled that by-laws with blanket bans on pets were harsh, unconscionable, or oppressive, the Strata Schemes Management Act 2015 (“SSMA”) underwent an amendment.

The amendment introduced section 137B of the SSMA and clause 36A of the Strata Schemes Management Regulations 2016, enshrining into legislation that by-laws cannot prohibit the keeping of animals, except in very limited circumstances. Now, the Community Land Management Act 2021 (“CLMA”) is also undergoing amendments, including the addition of section 129A, similarly prohibiting by-laws from preventing the keeping of animals in communities, except in specific situations.

Upcoming amendments to the SSMA and CLMA address various contentious areas. These changes are not exclusive to the SSMA, as they are also partially mirrored in the CLMA, extending their applicability to community associations, neighborhood associations, and precinct associations.

One key amendment involves an explicit restriction, outlined in section 105A of the SSMA and section 108A of the CLMA, prohibiting owners corporations and communities from charging bonds or fees related to the keeping of animals.

Another significant addition is the introduction of section 139A in the SSMA and section 130A in the CLMA, providing greater clarity regarding assistance animals. The new provisions expressly state that a by-law can require evidence that the animal holds accreditation under the Disability Discrimination Act 1992 (“DDA”) of the Commonwealth and a statutory declaration verifying the animal has received the necessary training mentioned in the DDA.

A noteworthy change is also introduced to older pets by-laws in the SSMA. Clause 4(2) of Schedule 3 of the SSMA will be amended to solidify the validity of any by-laws that were in force before the commencement of the SSMA, emphasising that they must not contravene the SSMA.

These amendments to the SSMA are set to take effect on December 11, 2023. On the other hand, the amendments to the CLMA will be enforced following proclamation.

So, what does this mean for your owners corporation or community? The amendments add further specifications that pets by-laws must adhere to, marking the end of the era of blanket by-laws restricting pets in strata and community living.

The changes reflect the increasing number of people residing in strata and community schemes, with a growing desire for the option to have pets. While the amendments open the door to pet ownership, there are express restrictions on certain breeds, and provisions are in place in both the SSMA and CLMA to address issues such as excessive noise, attacks or menacing behaviour, persistent odours, or actions endangering the health of other occupants through infestation.

For owners corporations or communities, it may be prudent to review and consider updating their pets by-law in light of the Cooper decision and the incoming amendments.

Eight years ago, well time flies by regardless of if you’re having fun or otherwise.

I’m often asked, “how on earth did you end up in the Supreme Court of appeal”, “what did you do wrong” amongst other questions to try and rationalise having to go to such extremes for strata owners to regain their property rights.

Simply, I asked a question that made people uncomfortable, a very basic question that was ignored. When I persisted, I made people angry and eventually I exposed an extremely broken system that many didn’t want a spotlight on. The broken Strata System, that kept owners at the mercy of their strata committees, strata managers and building managers, easier to control I was told.

There is still so much work to do in this space, I know this because the backlash has not ceased, many other schemes also continue with their abuse of power and people, and I still receive an obscene amount of mail from owners at their wits end.

The below email changed the course of my life, it has been a rollercoaster ride on many levels. Do I wish I didn’t have to go through it all, sure, would I do it again, sure, why? Because I detest bullies and seeing people suffer at the hands of them. I also strongly believe it is our responsibility to do what we are personally capable of to create change and make an impact for others. This experience has only further cemented my path in educating and hopefully inspiring others to stand up and get off the fence, because apathy is one of the major issues in allowing this type of conduct to continue.

If you see wrongdoing, speak up, let them call you a troublemaker, let them try and intimidate you and call you horrible names but you continue anyway. It is the only way things have ever progressed and changed.
