XL BULLY BAN: FREE WEBINAR!!

We're continuing to receive enquiries at Cooper & Co Solicitors from worried dog owners and rescues about what might happen when the XL Bully ban comes into force at the end of the year and, in particular, how the exemption scheme / amnesty might operate. I suggest we get together online on Sunday afternoon at 3pm for up to an hour to chat through what we know. Doglaw specialist Solicitor Trevor Cooper, together with representatives from our friends at Deed Not Breed, will answer as many of your questions as we can. We also hope to have a dog warden and someone from a dog rescue to help us answer your queries.

In order to attend, we shall be using Zoom and so you will need a link from us. You can enrol (free) on the link below. Places will be limited and so it is first come first served. If you have specific questions, it would be appreciated if you could send them in advance (via the form).

Very important information in regards to the recent law changes around the XL BULLY ban

XL BULLY BAN: WHAT WE CURRENTLY KNOW

On 10th September 2023 the Home Secretary, Suella Braverman, posted on her Twitter page:-

“The American XL Bully is a clear and lethal danger to our communities, particularly children. We can’t go on like this. I have commissioned urgent advice on banning them”

This was followed on 15th September 2023 by the Prime Minister, Rishi Sunak, who said he would ban the breed under the Dangerous Dogs Act 1991 “by the end of the year”. DEFRA subsequently issued a statement that evening saying that the Environment Secretary will:-

1. Convene experts to define the American XL Bully ‘in the next week’
2. The Government will then lay a Statutory Instrument to ‘add it to the list of dogs banned under the Act. This will make it an offence to own, breed, gift or sell an XL Bully’ by the end of the year

DEFRA went on to say that there will be a transition period requiring owners to ‘come forward’ and that details of this will be provided ‘in due course’.

The UK’s Chief Veterinary Officer, Christine Middlemiss, is quoted on the BBC as saying on 16th September 2023 that the transition (which she called an “amnesty”) will require owners to register their dogs and take action including requiring the dog to be neutered, on a lead and muzzled in public, as well a requirement for the dog to be insured.

It's hard to be too precise about the next steps but the following is our ‘best guess’, pending further Government announcements:-

Q) Do owners of XL Bullies have to do anything now?
A) No, but it would be advisable to get your dog used to wearing a muzzle, as well as to get it trained, neutered, and insured.
N.B. When your dog is neutered, please ask the vet to make a record of your dog’s microchip number. For insurance it is likely to be third-party liability insurance required, not healthcare.

Q) How do I know if my dog is going to be on the banned list?
A) We shall have to wait to see the definition that is adopted.

Q) How can I get my dog exempted?
A) We’re not sure yet, but it seems as though it’ll be by an owner-led registration scheme which will probably require you to complete an application form, provide evidence of compliance with the conditions and pay for the details to be on the Index of Exempted Dogs.

Q) What if someone misses the deadline to have the dog exempted?
A) The owner (+ if different the person in charge of the dog) will be committing an offence punishable by a prison sentence of up to 6 months and/or an unlimited fine. The dog will be seized by the Police and there is likely to be a presumption that it shall be put down unless you can prove that it is not a danger to public safety. You may also be required to prove that there was good reason why you failed to comply with the amnesty.

Q) What will be the conditions.
A) If it follows the current position for an exempted dog, the requirements will be:-

• The dog is neutered
• The dog is microchipped
• Third party insurance is obtained (+ continues to be in force)
• A certificate of exemption is issued
• Keep the dog at the same address as the registered keeper except for up to 30 days in 12 months
• Notify the Agency of any change of address
• Notify the Agency of the death or export of the dog
• Keep the dog muzzled and on a lead when in a public place
• Keep the dog in sufficiently secure conditions to prevent its escape

Breach of any of these conditions will mean that the dog is no longer exempted.

Q) What are the offences likely to be?
A)
• Having possession or custody of the dog if it has not been exempted within the amnesty period
• To breed (or breed from) the dog
• To sell or exchange the dog
• To make or offer to make a gift of the dog
• Allow the dog to be in a public place without being muzzled and kept on a lead
• Abandon the dog or allow it to stray

Q) Will a rescue be able to rehome an XL Bully?
A) When the ban comes into force, unless the existing rules are changed, a rescue won’t be able to rehome an XL Bully unless it is going to someone who already has or has had responsibility for the dog, and in any event this would have to be approved by a Court.

This summary was produced on 16th September 2023 but this is a fast changing situation so you must not rely on it as legal advice.

It happens! What to do if your dog swallows their tennis ball!
Remember every second matters during a choking incident.
1. Place the dog on their back. Brace the back against the floor. Straddle the dog while adjusting yourself based on the size of the dog. Position the head in “in-line position” with the airway parallel to the floor.
2. Make an open diamond shape with your hands. Place your thumbs on either side of the trachea below the ball or object. Grip the “V” of the jaw using lip/cheek to protect fingers.
3. Push with a J-stroke down and out against the ball until it ejects from the mouth.
Both this method and the Heimlich method has been proven to work in these scenarios so don't hesitate to save your dog.

Last night saw the last week of puppy group! 🐶 🎓 Starting with a quick refresher over everything we’ve learnt and new targets set for all to practice at home. And of course we’ve got to finish on some fun and games with some prizes for humans 😉 I’m glad to hear you’ve all enjoyed the course as much as I’ve enjoyed teaching you all. This is the second dog in the last two weeks that we’ve had come in to our hospital with this type of bone stuck around it’s mandible. Separate companies but the EXACT same design.

Please do NOT buy this type of bone for your pup! It’s not worth the risk. Luckily for this patient, our technician was able to wiggle it free but our previous patient was under general anesthesia for nearly a half hour while we went through every tool in our arsenal to saw through both sides of the bone safely.
Both dogs are lucky that they did not end up with lacerations or broken teeth.

After a very interested post regarding training workshops we have secured dates that works for all and we are pleased to announce our first RECALL workshop will be held at TAILS of SWALE in Thirsk! This workshop will be held on May 14th 1-4pm with breaks for dogs and owners alike. The cost per dog is £45 for the duration. Positive training methods used only. We’re debating doing a loose lead workshop and a recall workshop over the coming months. These will last roughly 3 hours, giving you everything you will need to begin or perfect your dogs training. There will be 2 trainers leading the workshops enabling lots of help during the exercises for everyone. Only positive based training is used, further helping to strengthen your friendship with your dog.

✨It’s been a mad couple of weeks!! ✨

Here’s just a few quick glimpses into what’s happened and is still happening! This week is week 3 of puppy group 🐾 Time to start the last few things to teach and to start finessing all we’ve gone through and then we will start challenging them and pushing what they know. Behind the scenes it’s been a lambing session too! Some very gorgeous and some BIG lambs have been born. I’ve so missed the lamb races on the field but definitely not the mucking out. And most importantly of all!! Mummy Maeve has had her second litter! 6 gorgeous red collie puppies 😍 3 boys and 3 girls! Pupdates on the puppies will soon follow so keep an eye on the page!!

Look at this handsome face!!

This is Jock, Jock has had me to visit for some help with his training. He’s had an utter fabulous time and loved every second of it! We introduced some basics for lead work 🦮, jumping and also a ‘go to bed’ technique for mum to practice and perfect. Within just a short space of time Jock had things going in motion and will undoubtedly nail everything very soon! Clever boy, jock!! ✨

Burt has had massive improvements with his lead work training!! ✨ His recall is also coming along incredibly well too, Burt and his mum should be very proud of them selves and the work they’ve done!

We’ve been working on his lead work and recall as he used to get quite excited seeing others playing around and wanted to dart over join in the fun. So we’ve worked on some stop commands and also some turning commands too so we can get him nice and calmly diverted to save poor mums arms! The progress they’ve made is so super to see as he’s had many distractions today including other dogs, cyclists and general life on the fields!
