Border Terrier breeder gets ‘stolen’ dog back

A Border Terrier breeder has got her dog back after it was allegedly ‘stolen’ from Birmingham National Show in May.
Charmaine Khatchikian said she was “so happy” to get her dog Sergei, Jrasamuyr Sergei Filin, back following the incident.
The dispute with Dutch couple Tonny and W***y Van Heck over the ownership of the dog was finally resolved when Ms Khatchikian agreed to pay them €4,000.
The Van Heck’s do not accept any blame or fault and insist they did not steal the dog. They felt they were taking back their property.
They had allowed Charmaine to show the dog in Paris and at the Border Terrier Centenary event. On April 28 they received an e-mail from Ms Khatchikian saying that she would not be returning the dog to them because she felt they had too many animals and not enough money. Claims they deny.
Ms Khatchikian said she had returned the money they paid for the dog €3,200. This is also denied by the Van Heck’s.
As she would not return the dog W***y Van Heck decided to go to the Staffordshire Show Ground and take the dog to The Netherlands. Charmaine had put a “No Export Pedigree” restriction on the dog.

A legal wrangle ensued until the Van Heck’s solicitor sent an e-mail which said, ‘Although my clients do not accept any blame or fault, they are prepared to hand over Sergei after the following conditions are met:
‘€4,000 is paid, we have received (i) a written consent to these conditions and (ii) the € 4.000; after that Sergei is handed over at my office; the person that receives Sergei signs for receipt; Mrs. Khatchikian stops all communications to my clients as from today; she stops all communications about my clients as from today.’
Ms Khatchikian agreed to these terms and an agreement was signed by her and Tonny Van Heck as they handed over the dog to Charmaine.
Afterwards Charmaine thanked The Kennel Club, the Dutch Kennel Club (Raad Van Beheer) and the four policemen who were there to help as the dog was handed over.
She told OUR DOGS she paid the money because, ‘I have been receiving counselling, I have been put on anti-depressants. I paid it; I would have paid €10,000! I had the counsellor with me. The whole point is, the €4,000, the council have an association. They have actually paid half the money because I was suicidal.’
She was pleased to get him back and after giving him a bath she said, ‘He smells lovely. He looks beautiful now. He looks like a Crufts puppy.’
Despite the fact it has cost her over €10,000 in legal and other fees she said, ‘I just feel better, I can get on with the rest of my life.’
W***y Van Heck told OUR DOGS, ‘Her mental coach suggested that Miss Khatchikian give that amount for the dog. That proposal did not come from me. Of course, it cost me a lot of money, but I take that for granted.’
Because of the legal costs Mr Van Heck was forced to sell a horse and the dispute has affected his health. He said, ‘With pain in my heart I said goodbye to Sergei and hope to get some rest now.’
