Hi friends iam Advocate Senthil Kumar from Madurai. I wish to share some facts about the present notification which is in issue.
1. This notification is about aerial birds.
2. Aerial birds are small birds of wild in nature which has the habbit of eating insects which fly in air. So almost these birds avoid eating in land. They spend their full life in capturing insects in air.
3. Most of the exotic small breeds don't have this habbit.
4. In the notification they discussed about some court judgements regarding birds. It's true long back some cases were in court regarding illegal trade and cruelty alone.
4. Since many persons transport huge number birds in a very tiny cage, many of them died. So animal welfare board and other forest officials tried to stop such cruelty.
5. Since birds were crushed in small cages, Court also expressed their opinion that they have right to fly.
6. In another case lower court ordered to let the exotic birds free in air. That was again challenged in court and the superior court quashed that order by mentioning that these birds cannot live in wild or in open becoz they all aviary birds.
6. After meeting several cases regarding illegal transport of birds from boarder they planned to regularise the birds trade. So they introduced parivesh voluntary disclosure plan.
7. When this matter became another issue in supreme court. The Honorable supreme court clearly stated that we all have right to breed, trade and exhibit birds with a condition that we have to complete our parivesh voluntary disclosure. Further it also mentioned that after completing our parivesh registration, no law or no officers concern should interfere in our business.
8. As of now we have no issues and to think much about our exotic birds.
9. The judiciary process is even though the advisory pass any order or notifications from central, it must be ratified by the state government. The state government should pass appropriate orders to execute any such rules.
10. The paper and news media without discussing in detail simply placed a macaw picture to creat an alarm and advertisement.
11. Finally in the end of the government notification it is clearly stated to ensure the guidelines of the court and nothing more.

If in future anything happens against exotic birds we all here to fight in the court of law.

வணக்கம் நண்பர்களே மதுரைச் சேர்ந்த வழக்கறிஞர் செந்தில்குமார் கூறியது:
தற்போதுள்ள அறிவிப்பைப் பற்றிய சில உண்மைகளைப் பகிர்ந்து கொள்ள விரும்புகிறேன்.
1. இந்த அறிவிப்பு வான்வழி பறவைகள் பற்றியது.
2. வான்வழி பறவைகள் இயற்கையில் காடுகளின் சிறிய பறவைகள், அவை காற்றில் பறக்கும் பூச்சிகளை உண்ணும் பழக்கத்தைக் கொண்டுள்ளன. எனவே கிட்டத்தட்ட இந்த பறவைகள் நிலத்தில் சாப்பிடுவதைத் தவிர்க்கின்றன. அவர்கள் பூச்சிகளை காற்றில் பிடிக்க தங்கள் முழு வாழ்க்கையையும் செலவிடுகிறார்கள்.
3. கவர்ச்சியான சிறிய இனங்கள் பெரும்பாலானவற்றில் இந்த பழக்கம் இல்லை.
4. அறிவிப்பில் அவர்கள் பறவைகள் தொடர்பான சில நீதிமன்ற தீர்ப்புகள் பற்றி விவாதித்தனர். சட்டவிரோத வர்த்தகம் மற்றும் கொடுமை தொடர்பாக மட்டும் சில வழக்குகள் நீதிமன்றத்தில் இருந்தன என்பது உண்மைதான்.
4. பல நபர்கள் மிகப் பெரிய எண்ணிக்கையிலான பறவைகளை மிகச் சிறிய கூண்டில் கொண்டு செல்வதால், அவர்களில் பலர் இறந்தனர். எனவே விலங்கு நல வாரியமும் பிற வன அதிகாரிகளும் இத்தகைய கொடுமையை நிறுத்த முயன்றனர்.
5. பறவைகள் சிறிய கூண்டுகளில் நசுக்கப்பட்டதால், பறக்க உரிமை உண்டு என்று நீதிமன்றமும் தங்கள் கருத்தை வெளிப்படுத்தியது.
6. மற்றொரு வழக்கில் கீழ் நீதிமன்றம் கவர்ச்சியான பறவைகளை காற்றில் விடுவிக்க உத்தரவிட்டது. அது மீண்டும் நீதிமன்றத்தில் சவால் செய்யப்பட்டது மற்றும் உயர் நீதிமன்றம் இந்த பறவைகளை காடுகளில் வாழ முடியாது அல்லது திறந்த பெக்கோஸில் பறவை பறவைகள் அனைத்தையும் குறிப்பிட முடியாது என்று குறிப்பிட்டு அந்த உத்தரவை ரத்து செய்தது.
6. போர்டரில் இருந்து பறவைகளை சட்டவிரோதமாக கொண்டு செல்வது தொடர்பாக பல வழக்குகளை சந்தித்த பின்னர் அவர்கள் பறவைகள் வர்த்தகத்தை முறைப்படுத்த திட்டமிட்டனர். எனவே அவர்கள் பரிவேஷ் தன்னார்வ வெளிப்படுத்தல் திட்டத்தை அறிமுகப்படுத்தினர்.
7. இந்த விவகாரம் உச்ச நீதிமன்றத்தில் மற்றொரு பிரச்சினையாக மாறியபோது. மாண்புமிகு உச்சநீதிமன்றம் *பறவைகளை இனப்பெருக்கம் செய்வதற்கும், வர்த்தகம் செய்வதற்கும், காட்சிப்படுத்துவதற்கும் நாம் அனைவருக்கும் உரிமை உண்டு என்று தெளிவாகக் கூறியது.*
எங்கள் பரிவேஷ் பதிவை முடித்த பின்னர், எந்தவொரு சட்டமும் அல்லது எந்த அதிகாரிகளும் எங்கள் வணிகத்தில் தலையிடக்கூடாது என்றும் அது குறிப்பிட்டுள்ளது.
8. இப்போதைக்கு எங்களுக்கு எந்த பிரச்சினையும் இல்லை, நமது கவர்ச்சியான பறவைகளைப் பற்றி அதிகம் சிந்திக்கவும்.
9. நீதித்துறை செயல்முறை என்பது ஆலோசகர் எந்தவொரு உத்தரவையோ அல்லது அறிவிப்புகளையோ மத்தியில் இருந்து அனுப்பினாலும், அதை மாநில அரசு அங்கீகரிக்க வேண்டும். இதுபோன்ற எந்தவொரு விதிகளையும் செயல்படுத்த மாநில அரசு தகுந்த உத்தரவுகளை பிறப்பிக்க வேண்டும்.
10. காகிதம் மற்றும் செய்தி ஊடகங்கள் விரிவாக விவாதிக்காமல் ஒரு அலாரம் மற்றும் விளம்பரத்தை உருவாக்க ஒரு மக்கா படத்தை வைத்தன.
11. இறுதியாக அரசாங்க அறிவிப்பின் முடிவில் நீதிமன்றத்தின் வழிகாட்டுதல்களை உறுதிப்படுத்த தெளிவாகக் கூறப்பட்டுள்ளது, அதற்கு மேல் எதுவும் இல்லை.
