On this day, WE HAVE SAVED 40 DOGS of RESCUER RANDY MIJARES (FB name) from imminent CONFISCATION by the barangay and city pound, as insisted by a Barangay Kagawad, accompanied by a Purok Leader, Barangay Tanods, and Homeowners Association members.

RANDY has just moved the rescue dogs into the residence in question no more than one day earlier. However, suspiciously, there has already been a petition by the neighborhood association. We suggested that they refer the complaint to the proper agency for validation and substantiation.

Animal Welfare Advocate NORMAN MARQUEZ had been asked by some advocates to rush to the location of the rescuer to intervene and talk to the concerned barangay officials and remind them of their MISCONCEPTIONS and ABSENCE OF LEGAL BASIS of their actions which may constitute grave abuse of discretion, oppression, grave coercion, oral defamation (slander), and/or unjust vexation.

MARQUEZ sternly advised the barangay officials THAT:

THERE IS NO NATIONAL LAW that restricts the number of pet animals that any PRIVATE INDIVIDUAL (including RESCUER), or HOUSEHOLD, can own or keep, within the confines of his/her premises, notwithstanding in a RESIDENTIAL AREA, provided the person or household observes and/or complies with the relevant national statutes, and their respective Implementing Rules and Regulations (IRRs) and supplemental legislations, policies and issuances.

It is not even an issue of, or relevant to, “NUMBER” or “SPACE” or “CAGES,” "WHETHER EFFECTING RESCUES," or "WHETHER ASKING DONATIONS, " since the bottom line has always been “ANIMAL WELFARE” -- whether a person or household has ONE, or TEN, a HUNDRED, or a THOUSAND companion animals -- THERE IS NO NATIONAL LAW that IMPOSES A RESTRICTION on the number of pets that any private individual, or household, can own or keep, PROVIDED that they are MAINTAINED WITHIN THE THE PREMISES of the person or household, and PROVIDED FURTHER that the private individual, or household:

(1) GUARANTEEES the FIVE BASIC FREEDOMS of ANIMALS under Section 6 of R.A. No. 8485, the Animal Welfare Act of 1998, as amended by R.A. No. 10631,

(2) COMPLIES with the RESPONSIBILITIES of a pet owner under R.A. 9482, the Anti-Rabies Act of 2007,

(3) DOES NOT CAUSE NUISANCE to the COMMUNITY as defined under Chapter 19 (Nuisance and Offensive Trades and Occupations) of Presidential Decree No. 856 , Code on Sanitation of the Philippines, i.e. NOT CAUSING any of the following:

(a) OBJECTIONABLE ODOR emanating from pets, and their f***s and urine, emitted into public areas or neighboring premises,

(b) EXCESSIVE NOISE from relentless dog barking that disturbs the neighbors or community, and

(c) SOLID & LIQUID WASTE associated with pets (noxious matter such as f***s and urine, related refuse and/or wastewater from the cleaning thereof) being DISCHARGED IMPROPERLY into the streets or neighboring premises.

NOTE THAT ANY NUISANCE COMPLAINT must be validated or substantiated only by the CITY/MUNICIPAL HEALTH OFFICE SANITATION Department, as sole mandated agency.

THE THREE LAWS MENTIONED ABOVE SERVE AS BASIS FOR DUE PROCESS to determine whether or not a PET OWNER OR RESCUER is RESPONSIBLE or CAPABLE.

THEREFORE, it is a deprivation of the RIGHT to DUE PROCESS under the Philippine Constitution (Bill of Rights Article III Section 1) of the pet owner or rescuer to ARBITRARILY IMPOSE A CEILING on the NUMBER of pets that he/she may own or take care of, regardless of whether or not he/she is engaged in rescuing and asking for donations.

UNLESS the PET OWNER or RESCUER voluntarily applies, he/she MAY NOT BE CLASSIFIED as ANIMAL FACILITY (associated with trade) and MAY NOT BE COMPELLED to secure BAI Registration and Mayor's Permit, PROVIDED he/she does not engage in trade or fee/income-generating livelihood, such as:

1. buying/selling of live pets
2. adoption for a fee
3. stud/mating service for fee
4. K-9 security services
5. pet training for fee
6. pets in tourist photo ops
7. pets in transportation for fare
8. pets in movies/circus for fee
9. pets in entertainment for fee

AS LONG AS (a) THERE IS NO SUCH THING as LICENSED RESCUER PROFESSION regulated by the PRC, and (b) he/she does register as a NON-PROFIT CORPORATION, a RESCUER may not be required to secure license or permit. Moreover, DONATIONS may not be treated as income.





FORTUNATELY, DIPLOMACY PREVAILS after MARQUEZ talked to the concerned Kagawad, Purok Leader, Barangay Officials, and owners of the property.

2:30 pm. Two drunk suspects conspired to club to death with a metal pipe a 7-year-old male aspin dog named SAMBA, with the intention of slaughtering the dog for delicacy (pulutan) during their drinking spree.

3:24 pm The owner of the dog, Gelai Bernado Rosal called Animal Welfare Advocate NORMAN CORDERO MARQUEZ, and he immediately advised them to promptly report to Baguio City Police Station 10 to effect an arrest in ongoing commission of a crime (warrantless arrest), to eliminate the need for regular filing for Preliminary Investigation.

Upon arrival, MARQUEZ talked to the police thru the phone of ROSAL and explained the condition of the crime and their mandate under Republic Act No. 8485, the Animal Welfare Act of 1998, as amended by RA 10631.

5:00 pm. The suspects were finally arrested and were also tested for drugs. They are now detained at the BCPO Station 10 along Marcos Highway.

JUNE 19, 8:00 am
The suspects was presented for Inquest Proceedings with the Office of the City Prosecutor (OCP).

MARQUEZ travelled to Baguio City to meet with the Police Investigator and Arresting Team and to attend the Inquest Proceedings.

For violation of RA 8485, as amended by RA 10631, resulting to the death of a dog, the suspects may suffer penalty of FINE of up to P100,000 and/or IMPRISONMENT of up to 2 years. BAIL is at P12,000 which they may avail on JUNE 20, after serving jail time of 2 days.

MARQUEZ is founder of Baguio Animal Welfare (BAW) and the League of Animal Welfare Organizations of the Philippines (LAW Org Ph). BAW has started animal welfare advocacy in 2016 and has since created a ripple effect and for 8 years now the group, BAW CoRe Ph (BAW Cordillera to theorist of the Philippines) has been engaging in rescues and pursuit of justice nationwide.

ALAM MO BA, sa Senate Bill No. 2458, Revised Animal Welfare Act, ni Senator Grace Poe, na kapag 10 o pataas ang alaga mo, kailangan ka na mag-apply ng BAI Registration? at Mayor’s Permit? siyempre kasunod na rin ng BIR Certificate of Registration, at kailangan ka na magpaimprenta at mag-issue ng resibo, magbayad ng buwis kada taon o tuwing ikatlong buwan, at magpasa ng Income Statements (paano? magtanong at magbayad ka na lang ng CPA accountant). Kung di mo magawa ang mga ito, magmulta ka o makulong ka na parang kriminal.

PERO PAANO KA MA-APRUBAHAN kung nasa “residential area” ka? hindi ka pala papasa sa Zoning Ordinance, o sa DENR environmental restriction. Relocate o lumipat ka sa “agriculture land” sa bukid o bundok, at doon kailangan ka pa rin mag-apply ng BAI Certification at Mayor’s Permit, at BIR Certification.

AT BAGO KA MA-APRUBAHAN, dahil nga maituturing ka na ngang establisimyento, may magpupunta munang mga inspektor mula sa City Veterinary Office o Municipal Agriculture Office, Sanitation, Building Official, Fire Department, Environment, at BAI, at titingnan ang septic tank mo, palikuran, pwesto ng kulungan (paano kung nakakagala lang sila sa loob ng bakuran mo at sa loob ng bahay?), baka kailangan mo pa ng fire extinguishers, fire escape, masilip pa kung pasado ka sa New Building Code.

AT DAHIL ESTABLISIMYENTO KA NA, pwede ka nang bisitahin (na parang karinderya) ng Barangay, HOA, mga ahensya ng gobyerno na nabanggit, sa araw at oras ng trabaho ng gobyerno.

KUNG LUMABAG KA, makulong ka ng 6 na buwan hanggang 1 taon at/o multa ng hanggang P10,000. At makumpiska pa ang lumampas sa siyam (9) na alaga mo. Hindi mo naman pwede ipasa sa mga shelters at pare-pareho kayong nasisita. Kaya mai-impound talaga lahat sila nang libo-libo, at dahil di nga kakasya sa mga kulungan ng city/municipal pounds, at hindi naman nila pwedeng pakainin ang daan-daan, o libo-libo na mga kinumpiska at sinurender, dahil hindi nila mandato at walang budget, wala naming nag-aadopt, kailangan ang agarang pagpapatulog (euthanasia) at gagastos ba sila ng P400+ kada a*o/pusa para lang patulugin nang naaayon sa batas?

BILANG SHELTER, kailangan may partner licensed veterinarian ka para magamit mo license number niya sa permit, at siyempre may araw ng obligadong pag-bisita na sa tingin mo makalibre ka? (ganyan ang kalakaran sa mga pet shops na hindi vet clinic). Swerte kung di ka papagbayarin ng vet, at kung may pumayag sa iyo, kasi nga naman baka masabit ang lisensya nila kung magkabulilya*o ka. Isa pa, obligado sila magpasa ng report sa BAI, dagdag trabaho nila. Kailangan din sa istriktong implementing rules ng shelter ang clinic/treatment room (euthanasia room ang termino), stockroom ng pagkain ng alaga na di dina-daga o ini-ipis at walang moisture, proper ventilation, running water, medicine supplies, etc.

WALA KA NANG PANAHON MAG-ALAGA NG MGA ASO’T PUSA MO dahil unahin mo muna ang mga report, pagtupad sa mga obligasyon sa gobyerno, at ang perang ipapakain at ipapagamot mo sa kanila ay mapupunta pa muna sa buwis/tax, mga processing fees/charges, multa sa atra*o, lagay/padulas/regalo kung kailangan o malambingan, pagpapa-print/photocopy, pagpila-pila, paglakad-lakad, at pamasahe (pwedeng tiis ka na lang muna huwag kumain). Baka kailanganin ka pa nilang ipa-repair/renovate ang bahay mo.

AT KUNG NANGHIHINGI KA NG DONASYON O NAGRERESCUE NANG AYON SA KAHULUGAN SA BATAS NA IYON. Bakit may batas ba na nagbabawal manghingi ng tulong para sa kapamilya o alaga mo? Nanghihingi ba ng DSWD Certfication ang kung nanghihingi ka ng tulong sa kapamilya mo (senior, PWD, scholarship)? Bakit ang mayaman lang yata ang may karapatan mag-alaga ng sampu (10) pataas na a*o at pusa? Anti-poor ba ang batas na ito, na kapag tinuturing ka na di-mayaman ay hindi ka na maituturing na may-kakayanan mag-alaga ng sampu pataas na a*o at pusa at kailangan ka nang kumuha ng BAI Registration, Mayor’s Permit at BIR Registration na parang tindahan, restaurant, o vet clinic? Magkibit-balikat o sikmurain mo na lang ang mga a*o’t pusa na nakikita mo na nangangailangan ng pagpapagamot, lalo na kung 9 na ang alaga mo.

AT KUNG PINANGANGALANDAKAN MO RAW SA PUBLIKO NA “SHELTER” (“animal facility”) KA. Bakit trade name ba ang Facebook? Requirement ba sa Facebook ang DTI o SEC Certificate? So what kung may nakakabit sa FB name mo ang “Animal/Pet,” “Shelter,” “Sanctuary,” “Haven,” o “Paradise,” hindi ka ba pwede mangarap sa social media man lang? Ang importante, hindi ka nagtitinda ng hayop, o karne nito, o ginagamit ang hayop sa serbisyong may bayad -- katulad ng sa negosyong piggery, poultry, o pet breeder, atbp., o paggamit ng hayop sa K-9 security, entertainment, pagpapalitrato sa turista, o transportasyon, bilang negosyo may tubo (profit).

Justice for Brown of San Pablo Laguna

UPDATE FEB 4 2019 (MON), San Pablo City, Laguna: ONE GIANT LEAP TO VICTORY TOWARDS JUSTICE for BROWN, a “LANDMARK CASE” for the ANIMAL WELFARE ADVOCACY! On JANUARY 30, 2019, after 166 days (5 months & 13 days) from the alleged cold-blooded shooting of an aspin dog named BROWN, Assistant City Prosecutor JOHN-JOHN A. CABRAL (Investigating Prosecutor), approved by City Prosecutor DOMINADOR A. LEYROS, the JOINT RESOLUTION was issued recommending that an INFORMATION for VIOLATION of SECTION 6 of RA 8485, the ANIMAL WELFARE ACT of 1998, as amended by RA 10631, be FILED against a POLICE SENIOR INSPECTOR in the province of LAGUNA, with recommendation for issuance of WARRANT OF ARREST. On FEBRUARY 4, 2018, accused filed a MOTION TO POST BAIL Pending Raffle and it was granted by Presiding Judge ANTONIO O. DEL VAL. RECOMMENDED BAIL for the PROVISIONAL LIBERTY of the accused was hereby fixed in the amount of EIGHTEEN THOUSAND PESOS (P18,000) which was paid in cash on the same day.

The 18-page formal complaint was filed directly with the CITY PROSECUTOR’S OFFICE of San Pablo, Laguna, with the assistance of NORMAN C. MARQUEZ, Senior Animal Welfare Advocate of Baguio Animal Welfare (BAW) Cordillera to the Rest of the Philippines (BAW CoRe PH), on AUGUST 24, 2018, ONLY 6 DAYS after the gruesome incident. On OCTOBER 4, after 47 days (1.5 months) of preliminary investigation (exchanges of affidavits), the case was submitted for resolution by the investigating prosecutor. Since the RESPONDENT (accused) complicated the case with COUNTER-CHARGES, it took the prosecutor unusually long (119 days, or 4 months, instead of 1 month only) to come out with a Resolution. In a desperate bid to thwart the complaint, the RESPONDENT filed COUNTER-CHARGES to all the participants (complainant and witnesses) including a family member and 2 advocates who are sympathetic with the complainant. However, they were all effectively countered and were all DISMISSED for LACK of PROBABLE CAUSE or LACK of MERIT. DISMISSED for LACK of PROBABLE CAUSE: 1. PERJURY vs. complainant LAMBERTO A. TY 2. TO RESTORE OUR HOPE & FAITH IN THE JUSTICE SYSTEM. ------------- UPDATE OCT 4 2018 (THU), San Pablo City, Laguna: The parties held their 3rd Preliminary Investigation Meeting at the office of Investigating Prosecutor JOHN-JOHN A. CABRAL, wherein RESPONDENT submitted his REJOINDER-AFFIDAVIT. Investigating prosecutor shall then prepare the RESOLUTION and INFORMATION should he find probable cause to hold the respondent for trial for the crime of violation of the Animal Welfare Act of 1998, for, having with felonious intent, deliberate malice, premeditation and stealth, cold-heartedly shot a defenseless and unsuspecting dog, named BROWN, at around 11:15 p.m. in the evening of August 18, 2018, causing instant death thereto.

UPDATE SEP 27 2018 (THU), San Pablo City, Laguna: The parties held their 2nd Preliminary Investigation Meeting at the office of Investigating Prosecutor JOHN-JOHN A. CABRAL, wherein COMPLAINANT submitted his REPLY AFFIDAVIT and presented 2 more witnesses. Next schedule of meeting will be on October 4 for the final submission of REJOINDER-AFFIDAVIT by RESPONDENT.

UPDATE SEP 13 2018 (THU), San Pablo City, Laguna: The parties were called for 1st Preliminary Investigation Meeting at the office of Investigating Prosecutor JOHN-JOHN A. CABRAL, wherein Respondent submitted his GANTING SINUMPAANG SALAYSAY (Counter Affidavit in Pilipino).
