Bizarre ruling by Judge Anderholt of Imperial on 1/21 (ELC011200) implies that any park owner can easily take possession of any mobile home that is owned by the tenant (park only owns land) with negligible legal costs.
In 2017 an Unlawful detainer was forced against Ken Perry, mobile homeowner, by the MH park, when they refused to accept rent. Judge Jones threw out case because manufactured home owners can't be evicted simply for nonpayment of rent because of difficulty of moving a home.
Now Perry, a disabled senior, who was withholding rent to pay for repairs not done by MH park (that was their responsibility) has another UD, which he expected but hoped to force into arbitration and one or other party do repairs. Imperial County had banned CA Housing Devel Corp from county so no mediation had been available to him and he wanted the court's mediation. Anderholt ruled repairs weren't necessary and other alleged harassment and retaliation for Perry discovering and reporting code violations was irrelevant. Filed for plaintiff and awarded parcel, telling Perry to move the 42 year old triplewide in 10 days. (breaks Civil Code 798.55 a and b and 798.29.6 among others.) When ruling was issued, this had been changed to award of parcel and home. If the repairs question and harassment are removed, park is awarded home for non payment of less than $1500 rent, which was in a separate account, ready for payment if judge ruled park must do repairs. In Perry's case, the home is one of the largest in the park with a terrific view so highly coveted.
Combined with the ability to force UD by refusing rent, this sets the precedent that any park owner can take possession of any mobile home that is owned by the tenant (park only owns land) by simply not taking the rent and filing with the court.

Imperial County has allowed landlords to increase rents up to 8% while the CPI is 2.4% and SSI cost of living increases are under 2%. so in 3 years rent will rise 24% cost of living increases will be 3.6%. Let's do the math and with in a few years many seniors will be homeless. Thank u to Ryan Kelly and the sh*tty Imperial County Board of Supervisors for protecting 1% while screwing 99% of the people that voted for them.
