Ok so we did a thing 🥹
In memory and honor of the horses that we have lost over the years..
We learned of a few horses hat were in dire need of a soft place to land..
- A Mom and 2 month old foal
-A young blind almost yearling c**t that has bonded to the mom and foal and
-A Belgian C**t Just under 2 whose Mom was sold and he was left behind lost and confused.
We have committed to these 4 but need your help to bring them HOME..
EVERY PENNY DONATED HELPS US HELP THEM.
We put down the deposit to hold them from slaughter and with a couple of generous donors it brought down their bail
but we still have $3515.00 of their bail that needs to be paid.
We have them in Quarantine currently and are arranging vetting, their coggins certificates, paper work and transport HOME to BPS when QT is done

Due to the economy these days, even bail prices have nearly doubled along with grain, hay, vetting etc.

PLEASE HELP US HELP THEM..any amount would be most gracious and appreciated.
If we can NOT come up with their remaining bail etc SOON ...
WE FEAR THEY WILL ALL BE PUT AT RISK AGAIN FOR DIRECT SHIP TO SLAUGHTER..

AUTUMN’S COLD HEARTED WINTER



The wildlife of New Jersey is a natural resource for all to enjoy. Each citizen enjoys nature in their own way.

In June 2021 a baby deer wanders onto a wooded property in Middletown New Jersey. A caring family sees her flopping around, lost with no mother in sight. The family gives the fawn a safe place to stay providing her with necessary sustenance.

The baby survived and got stronger. She eventually joined a herd that would roam the wooded area around neighboring properties.

The fawn would regularly return to the home of these good samaritans. The fawn would visit the kids and the family dog and then return to the herd.

The family named her Autumn.

The children told her that she would marry a reindeer and help deliver presents at Christmas.

While Autumn was nestled down with her herd, a poacher trespassed to target the deer.

He shot Autumn and left her until dark. He trespassed again after dark and “stole” her.

Discovering the tracking collar on Autumn, he removed it and brought it down the road to make it appear that she ran from his property.

The Monmouth County SPCA working under assistant prosecutor Melanie Falco consulted on this case and decided that:

“Criminal charges are not appropriate against any parties to this incident.”





It is sad to think that animals in this state depend on the likes of these people.

Don’t let your heart be troubled, the Good Samaritan in this case feeling frustrated and powerless signed criminal complaints in spite these agencies shirking their duty.

A Judge found probable cause and docketed the criminal case.

A private citizen has stood up for justice in this case. A true example of how the system should work. We will keep you informed as this case proceeds.

The needlessly killing case of a fawn named Autumn by a poacher is set for trial on

Because the Monmouth County SPCA and Assistant Prosecutor Melanie Falco can’t risk being embarrassed by a private citizen, the pressure is on the Municipal Prosecutor John Lane to make the criminal charges go away.

● Mr. Lane will find all kinds of reasons NOT to pursue the charges that a Judge has docketed.
● He will claim that this is a matter of Fish Game and Wildlife only.
● He will claim that you can steal a deer because the state owns the deer.
● He will claim that the property owners must file trespassing complaints and the case can’t proceed.
This is all double talk to fool the public as he shirks his duty.

Please see the attached memorandum that has been provided to the prosecutor. This memorandum answers ALL these issues and makes the criminal violations clear.


STATE vs MARCELL

MEMORANDUM


When it comes to activity authorized by the state, licensing is required. The law prescribes parameters that must be followed. To act outside those parameters is “unlawful” and removes any umbrella of protection that is conveyed by licensure.

This defendant is an avid hunter with years of experience. He is well versed in the laws related to hunting.

On December 31 the defendant killed a deer and removed it from a property on Cooper Road in Middletown New Jersey. On Jan 2, 2022 the defendant was interviewed by Fish Game and Wildlife Officer Shannon Martiak.

Martiak’s official report presents the following significant points and statements by defendant:
● Shot deer on 299 Cooper Rd as per defendant
● Retrieved deer from 295 Cooper as per defendant
● Removed tracking collar to avoid apprehension as per defendant
● Both properties are “residential” as per Captain Martiak of FGW


*State must subpoena Shannon Martiak

The property owners at 295 Cooper Rd and 299 Cooper Rd will testify at trial that they did not and would not allow any person onto their property for the purpose of hunting.

This will establish that the defendant was trespassing. The predicate of trespassing makes all the defendants actions unlawful.
Hence the charge of “needlessly killing a living creature” If a person has a lawful means of obtaining something they require, to obtain it unlawfully is not necessary. There is no useful motive to act unlawfully. This is the legal definition of “needless”
Case law states that the courts must rely on plain meaning of the language in interpreting the law.

(Legal argument/ case law provided to prosecutor)

Based on the unlawful entry onto the property at 299 Cooper Road with a weapon used to needlessly kill a living animal, an unlawful act, the charge “possession of a weapon for unlawful purpose” is appropriate
Based on the unlawful entry onto the property at 295 Cooper Road, the retrieval of the deer was unlawful. Hence the charge of “theft of property”

All parties agree that the deer is not owned by an individual but rather is owned by the state. The state will convey certain rights and privileges to property owners and hunters who lawfully take possession of a deer.

This conveyance is based on very detailed prescribed requirements. If these requirements are not met by an individual, that individual can make no claim to such privilege.

In this case State demands were flagrantly flaunted thus precluding the defendant from taking possession of this deer. To do so is clearly theft of the deer.

The prosecutor represents the state and thus has standing to pursue this prosecution.

Based on Martiaks report which outlines the defendant's admissions (which are admissible), the defendant said “I got scared” and brought the GPS collar down the road.

This shows a consciousness of guilt for his actions. Hence the charge “tampering with evidence to avoid apprehension”

A significant note for the prosecutor and the court: The Supreme Court of New Jersey in a binding decision has established that criminal matters are in the jurisdiction of law enforcement authorities and are not preempted because of Fish Game and Wildlife charges that may be levied.
(Published case law has been provided to the prosecutor.)

I submit that the public interest in this case warrants that the law enforcement authority (prosecutor) perform his statutorily mandated duty.

BABY BEARS CRUELLY KILLED

NO CRIMINAL CHARGES FILED
(DO NOT BE FOOLED)

In Passaic County New Jersey a Mama Bear is out foraging in a state park. She leaves her four young cubs to frolic in the area. When she returns she finds four lifeless bodies scattered about.

A local man who did not want the bears nearby just killed them all and left them there to rot.
Fish Game and Wildlife officers tracked down the killer and issued civil summons for various hunting violations. These are like expensive parking tickets.

These complaints are not criminal.

Any criminal complaints must be pursued by the Passaic County Prosecutor.

This is the law.

The public and the authorities erroneously believe that all criminal acts regarding wildlife is in the domain of the Fish and Game department.

This is incorrect.

Any action on the part of Fish and Wildlife authorities does not preclude other law enforcement authorities from pursuing criminal charges.

(This legal position has been confirmed by the New Jersey Supreme Court
in a published binding decision.)

It is now in the public interest for the county prosecutor to pursue the criminal nature of these acts.

I submit here the appropriate criminal charges:

N.J.S.A. 4:22-17 a ( 1 ) - Needlessly kill a living creature, a disorderly person offense - 4 counts

N.J.S.A. 4:22-17 c ( 1 ) - Cruelly abuse a living creature, a crime of the third ( 3rd ) degree - 4 counts

N.J.S.A. 2c:39 -4 - Possession of a weapon for unlawful purpose, a crime of the second (2nd) degree

♦️Jerome Horwitz, famous for playing CURLY in "THE THREE STOOGES", was known to all as a protector of dogs. Curly's contract with Columbia Pictures included a clause that allowed his dogs to accompany him on the studio lot. Columbia limited it to no more than two dogs at a time, this due to the puppies' unplanned on-camera appearances from time to time. You can still see those surprise dog on set invasions in the first few short films. Typically surrounded by various dogs, Curly was known to come home with a stray dog ​​and foster it until he could find it a permanent home. When the Stooges were out on the road, Curly took it upon himself to find a new home for at least one stray dog ​​in every town they visited. Curly is estimated to have saved and rescued more than 5,000 dogs in his lifetime. This makes him a man ahead of his time, with a very admirable concern for man's best friend.❤️
