Dear Ms. Fahmy:

I am in receipt of your letter dated March 7 regarding the online petition regarding the request for a dog park. Thank you very much for your complimentary message regarding the positive changes that have occurred in the Borough of Avalon. The Mayor, Council, and the entire Avalon team strives everyday to make this the best seashore community in the State of New Jersey.

I am individually aware of the number of residents, property owners, and renters who are dog enthusiasts. You can count me as being one even though I do not reside in our community. I have rescued unwanted beagles through my entire life and understand the joy and companionship they bring to your family.
You are correct in stating the restrictions of dogs on the beach and on the boardwalk and I expect that to continue due in part to endangered species issues, health safety and welfare, and liability issues.

In Avalon’s form of municipal government, the Mayor is the Chief Executive Officer of the community. Among many of the Mayor’s duties include “supervision of municipal property”. The Mayor may also propose legislation and veto ordinances if he or she chooses to do so. Any initiative to create a public dog park in the Borough of Avalon rests with the Mayor and the consent of the governing body, and would need to comply with all regulatory provisions established by other agencies (environmental, etc.). The Department of Administration does not have jurisdiction over this issue; the administration is an extension of the Mayor and generally is actively involved in the formation of policy to be considered unless otherwise directed by the Mayor. Elected and appointed officials are actively engaged with the Avalon Home and Land Owners Association throughout the year and appear frequently at their monthly meetings; however, any policy creation action rests with the elected officials exclusively.

That is the process. The Mayor has stated every year at the AHLOA general membership meeting in August that he would consider a dog park if first a location was identified and neighbors adjacent to the property were supportive of a dog park in their neighborhood. To date, that has not happened. If that happens, I suspect the Mayor would then consider the costs, insurance, environmental, legal, maintenance, liability, and other issues, along with the considering a balance of equities for best use of the parcel that is identified. Zoning and site plan issues may also be part of the consideration.

This is great news from our Mayor :

“Also on the agenda this morning are resolutions authorizing grant applications to the county open space program for a city dog park and a scenic observation tower at the north end of the city. This project has been a long time in the making; and as we know, Sea Isle City is a very dog-friendly community with many of our residents and visitors owning dogs. In fact, during the city’s last Master Plan reexamination, the request for a Dog Park was one of the most popular responses in surveys conducted at that time. Perhaps most telling was the fact that, in one of the survey questions about additional facility needs, over 40 percent of nearly twenty five hundred respondents asked for a dog park.

The scenic observation tower will afford people a great opportunity to witness the outstanding natural beauty of our island, with a great vantage point for viewing environmentally protected areas of the marsh and wetlands along with fantastic views of the beach and ocean.”

Dear Mr. Wahl: I write to you on behalf of 775 supporters of the development of a dog park in Avalon, N.J. Please see the Change.org link https://chng.it/ysmT48MY. These numbers reflect Avalon homeowners, renters, full-time and part-time residents, as well as people who love Avalon and dogs.

As a full-time resident of Avalon, and a 20 year homeowner, I can attest to the positive changes that have occurred in our town over the years, and I appreciate your efforts on our behalf. Avalon, NJ is a wonderful beach community with many amenities for families. But we are missing one key element: a dog park. Many year-round residents, owners, and renters are dog owners, and these numbers have increased dramatically during COVID. As you know, dogs are restricted from going on the beach April-September and are forbidden from going on the boardwalk at any time. Dogs are also not permitted on the grassy central median. Thus, there are no locations for our furry friends to run and play.

I am writing to you today not to discuss the merits or location of the dog park, but simply to inquire about the process of how a dog park would be approved. Is it solely in the purview of your good offices? Does the Mayor have the sole power to approve? Or does it go to a vote by the Avalon Borough Council? Does the Avalon Home and Landowners Association have a say? As I am sure you will agree, a transparent process in decision making is always the best form of governing the tax paying citizens.

Once we are able to understand the process, I would be pleased to dialogue regarding the substance: reasons the dog park is needed, identification of locations, costs, insurance, legal issues.

I eagerly await your response and thank you for your consideration of this matter.
