There are 33 days left for Congressional Review of the pending CDC Dog Importation Federal Regulations as currently published in the Federal Register.

Here is what you need to say when you call your local congress representatives office:

Ask if they are aware that the CDC published new dog importation federal regulations in the Federal Register on May 13th that is to go into effect August 1st if the regulations are not pulled by Congress. Document Number 2024-09676.

1) If they say, "No," inform them that the 311 page PDF published in the Federal Register on May 13th is a poorly written and inactionable "one size fits all" solution for the importation of dogs from every country in the world with no exemptions for the military, government employees working abroad, or service dogs in training as puppies.

The regulations have a negative impact on the airline industry by putting passenger service employees in a "policing" role regarding international paperwork. Customs and Border Patrol is to handle hand-carries and excess baggage entries with airway bills, but the airway bill system mentioned in the regulations is not how official customs entries are handled for these types of transports. A federal regulation should not have a "work around" when there is a clear and currently active system for these types of imports.

The airlines don't move swiftly and they could decide not to ship any animals at all from foreign ports into the U.S. which would strand families and animals. Some airlines overseas have already initially denied animals their travel looking for new required paperwork that hasn't gone into effect yet.

The regulations as currently published do not take into consideration NAFTA (North American Free Trade Agreement) that considers business and commerce between Canada, the U.S. and Mexico since in these pending regulations both Canada and Mexico are treated like every other country in the world.

The CDC did not truly consult "frontline stakeholders" that are responsible for moving dogs around the world every day.

And you would like your representative to consider the Congressional Review Act to have these regulations pulled and send the CDC back to the drawing board for regulations that make more sense and are actionable.

And ask if there is an email address where you can send the points above to help your representative have them in hand to read and act upon. (Please copy and paste the points above in the body of your email.)

2) If your representatives office says "Yes, they are aware of the pending federal regulations," ask if they have raised the above issues to:

-- the House Agriculture Committee (currently overseeing the Farm Bill that has the Healthy Dog Importation Act within) because this legislation is much more well thought out, but legislation takes time and we don't have much time before July 13th when the review period is up and August 1st when the regulations are to go into effect

-- the Energy and Commerce Committee that oversees the CDC

-- Airlines For America to discuss what the airlines have determined after their meetings over the past few weeks

The Congressional Review Act is not the easiest act to invoke, but it exists for this very reason. And while there are other legislative solutions to possibly consider, the 60-day review window for the CRA closes in 33 days.

The CRA (codified at 5 U.S.C. §§801-808) is a tool Congress can use to overturn certain federal agency actions. The CRA was enacted as part of the Small Business Regulatory Enforcement Fairness Act in 1996.

The CRA requires agencies to report the issuance of “rules”
to Congress and provides Congress with special procedures,
in the form of a joint resolution of disapproval, under which
to consider legislation to overturn rules. If a CRA joint
resolution of disapproval is approved by both houses of
Congress and signed by the President, or if Congress
successfully overrides a presidential veto, the rule at issue
cannot go into effect or continue in effect.

Starting on August 1, all dogs entering the U.S. (including those that left the U.S. and are returning, and regardless of the country they are coming from) must be:
• healthy upon arrival
• at least 6 months of age
• microchipped
• accompanied by a CDC Dog Import Form receipt and required vaccination and veterinary documents.

Additional requirements may apply depending on where the dog has been in the last 6 months and whether or not the dog was vaccinated in the United States.
