How to report animal abuse or neglect propperly without wasting time with ineffective authorities: (please share)
If the abuser is identified and there is an eyewitness that is willing to sign on affidavit and join in the filing direct to the Prosecutor's Office, and the victim owner or concerned animal lover would be willing to sign on Affidavit of Complaint...
STEPS you need to take to file the case to the Prosecutor's Office with the help of Senior Animal Welfare Advocate NORMAN C. MARQUEZ:
(1) REPORT the incident on Barangay BLOTTER for "record purposes" only and request for a CERTIFIED TRUE COPY of the Barangay BLOTTER to be attached to the Affidavit of Complaint.
To have a more thorough, accurate and effective blotter report, we suggest that you write the detailed statement (narration) of the incident that transpired on a piece of paper (full names, complete addresses, dates, times, location of crime) so that you may suggest to write it yourself on the blotter logbook, and for barangay to just acknowledge and certify.
There is no more need for CONCILIATION PROCEEDINGS with the Lupong Pangkapayapaan of the barangay because the Animal Welfare Act (AWA), being a national law, a special act, and a serious criminal offense, with maximum penalty beyond P5,000, is no longer under the jurisdiction of the barangay. UNLESS the complainant is only interested in an amicable settlement with the offender.
If the barangay official/s does not want to cooperate and they insist on settling the complaint in their office contrary to the wishes of the complainant, please call MARQUEZ and he will talk to the official concerned to remind him of his duty, failure to perform of which may constitute abuse of authority and/or obstruction of justice, and advise him of the penalties for violation thereof.
(2) REPORT the INCIDENT with the Police Station for "record purposes" only and request for CERTIFICATION of INCIDENT REPORT to be attached to the Affidavit of Complaint.
No need for police to investigate and file the complaint themselves with the Prosecutor's Office.
(3) REQUEST for MEDICAL CERTIFICATE from the attending licensed veterinarian, if applicable, detailing the cause of death and/or extent of injury of the dog, the treatment procedures undertaken, and the corresponding bills incurred.
The Medical Certificate needs to be attached to the Affidavit of Complaint, especially in cases of poisoning and gunshot.
(4) For VIDEO EVIDENCE, if any, we need the taker of video to sign on affidavit attesting to ownership and authenticity of the material, or if there is CCTV, we need the notarized certification of owner/ operator/ provider of CCTV equipment -- a requirement under the Rule on Electronic Evidence.
(5) SEND to the Messenger of NORMAN C. MARQUEZ the detailed statement (PDR form) of the acting complainant and witness/es so that corresponding affidavits may be prepared.
THERE IS NO FILING FEE in Court and the PROSECUTOR (fiscal) will act as the state-provided free lawyer/counsel.
WE WILL ASSIST in the drafting of affidavits, and whenever possible, accompany the actual filing of the complaint with the Office of the City/Provincial Prosecutor (OCP/OPP) of your city/province.
