Judge rules San Diego Humane Society’s policy of returning cats to community violates law

The decision is a victory for the animal rights groups and people who sued over the Community Cats Program

The San Diego Humane Society’s policy of turning away domesticated cats roaming outside and instead returning them back to where they were found without ensuring they have a caretaker violates the law, a judge ruled Friday.

San Diego Superior Court Judge Katherine Bacal’s decision following a bench trial is a victory for the animal rights groups and people who sued the organization, alleging its policy fails to take in the friendly, adoptable cats — which may be stray or abandoned — that people find and bring to the shelter, and instead routes the animals to a program for unowned, outdoor cats.

Bacal also said the agency’s policy of assessing only kittens brought to them — as opposed to all cats — to determine how social they are is “too narrow.”

The decision is a victory for the animal rights groups and people who sued over the Community Cats Program

...The lawsuit contends the organization’s approach to cats found outside is too broad. There is no dispute over the practice of trapping, neutering and releasing feral cats. The battle is over what the plaintiffs allege are potentially adoptable stray or abandoned cats. They argue that releasing those cat to live outdoors puts them in danger.
...The case went to trial — a bench trial with only a judge, no jury — running 12 days spread over a few months and recently wrapping up. San Diego Superior Court Judge Katherine Bacal is expected to issue her decision Friday.

This is Valarie.
I cannot even begin to count the number of ferals and semi ferals I've rescued. Most live in my house. A number of which live upstairs, will not even come downstairs. I cannot touch them but that doesn't mean they don't have the right to live. Very few people would do this.
Currently we're not doing rescue but are sanctuary.
Eventually we'll get back to adoptions and rescue.
I just need time off after 34 years in rescue.
God bless all these unwanted, unloved critters.

"...In 2019, an Arkansas resident accused Meyer of selling her a lethargic and sickly Savannah kitten for $4,500, according to a Texas criminal complaint. The cat soon died. A necropsy showed emaciation was a contributing factor.

That same complaint alleged Meyer had sold a Las Vegas resident five Savannah kittens for more than $16,000. After one of the cats was diagnosed with an infectious disease, all had to be euthanized, according to the complaint.

In 2020, a Nevada resident said she had agreed to purchase a Bengal kitten from Meyer for $6,500, according to another criminal complaint. After the buyer opened the bag that held the kitten, which was thrashing violently and hissing, the animal attacked her, drawing blood. She told police she later learned that Meyer sold her a Geoffroy’s cat — a wild species — not a Bengal, an exotic-looking domesticated breed.

According to the complaint, Meyer agreed to take back the cat but blocked the buyer on social media and changed her phone number without returning the $6,500.

I always say: One kitten is half a kitten. Two kittens are a whole!

Often, first-time adopters feel overwhelmed by the idea of bringing home a pair, and believe it will be easier to adopt a solo kitten…only to realize later that they wish they’d adopted a duo! As someone who reads a lot of adoption applications, trust me: a lot of solo-kitten adopters end up wanting a second kitten after all.

Paired adoptions make me happy, but I do lots of solo kitten adoptions too, as long as the adopter has another young cat in the home to be the kitten’s friend. Our kittens adjust beautifully to homes with young, playful cats! Interestingly enough, we didn’t have any paired adoption applicants for my current crew of 4…but we had several applications from people who had recently adopted a solo kitten and regretted not adopting a second!

One adopter told me that she’d adopted a kitten just days earlier, then went to the vet and was told “you need to get a second kitten,” so she applied with Orphan Kitten Club for a little friend. (LOVE that advice—thank you, vet!)

I share this to say that if you’re a first-time adopter considering a solo kitten, consider adopting a pair. I promise I’m not just trying to upsell you on kittens! Two kittens will keep each other entertained, learn new skills from one another, take out their energy on one another, and enrich each others’ lives. And when you adopt a pair of young friends or littermates, they’ll be bonded immediately!

If you’ve recently adopted a solo kitten and have no other cats at home, it’s not too late to get them a little buddy to bond with for life. Every time an adopter applies to pair one of our kittens with their new kitten, I tell them: you are making a very smart decision!
