TERMS AND CONDITIONS JANUARY 2023
The following terms and conditions apply to all orders placed with Lil’ Lady Cakes by Stacey
Receipt of your deposit indicates that you have agreed to the terms and conditions listed below.
Terms and Conditions are subject to change at any time.
Deposits/Quotes:
All quotations are valid for two weeks from the date of quote. After this time, a new quote may need to be obtained.
A 50% NON-REFUNDABLE DEPOSIT is required to secure your booking. Until this is received, I cannot guarantee your chosen date will remain available as I can only take on so many cakes at once.
Balance of all cakes must be paid one week prior to collection (or delivery if arrangements have been made).
Payments can only be made via bank transfer. Funds for deposit &/or full payment must clear into my account before any acknowledgment shall occur. Upon my receiving the cleared funds, you will be sent confirmation of your booking or full payment.
Your order will not be fulfilled unless I have received full payment in the above-mentioned time frame or we have both agreed to pay the remaining on pick up.
Pick up address will be sent to you prior to collection.
By paying for this cake, you agree that certain creative changes may be made to your final design for the sake of stability, structural integrity or other certain emergencies. By paying for this cake, it is an act of signing this contract that is legal and binding to the fullest extent of the law.
Allergens:
Lil’ Lady Cakes by Stacey is NOT an allergen free kitchen. While I do my best to make, bake and decorate cakes from my kitchen, your cake and materials used in the creation of your cake/s may contain or come into contact with allergenic products and or ingredients such as eggs, wheat, soy, diary, gluten, nuts, preservatives, colours and other allergens.
**It is your responsibility to notify your guests of all potential allergen risks and will not hold Lil’ Lady Cakes by Stacey responsible for anything at all allergy related.
Cake Collection Times:
Your collection time is pre-arranged with you for a time and day that is applicable to both you and I.
It is important to arrive on time or within the 15 mins allocated to you to pick your cake up. In most cases I will only be available for 15-20 mins either side of your pick-up time. After this time, I cannot guarantee that I, or anyone else will be here for you to collect your order. If you are running late, please send me a message or give me a call as it may be necessary to organise another time to collect your cake or deliver which will incur a fee. If you are not able to collect your cake at the scheduled appointment time, and/or cannot make alternate arrangements, your deposit and any payments made will be forfeited.

Care Instructions:
Buttercream cakes need to be kept refrigerated until shortly before serving but are best eaten at room temperature.
Fondant cakes are to be kept in cool temperature unless advised to store in the fridge. If refrigerated, fondant cakes must be kept in its original packaging and may need extra coverage to avoid any humidity forming which will result in the change of the quality of the cake.
Remove from refrigeration 1-2 hours prior to serving dependant on weather.
Your cake should never be left in a hot/heated environment or in direct sunlight.
Once cut, store in an airtight container in the fridge & consume within two (2) days.
Lil’ Lady Cakes by Stacey will not be held responsible for any changes if instructions are not followed.
Transporting your cake:
All cakes will be presented on a cake board and in a box. You need to transport & keep your cake/s on a FLAT surface and keep cool at all times. (Not on someone’s lap!)
I will not take responsibility for any damage incurred to your cake/s after the cake has left my premises. The condition of the cake is your responsibility and you assume liability for its condition once it leaves my care.
You are advised to keep anyone from touching or unnecessarily moving your cake as I will not be held responsible for any damages caused.
If delivery has been arranged Lil’ Lady Cakes by Stacey will not take responsibility for any damage/s that occur after delivery and/or set up.
It is your responsibility to ensure an adequate area is available for your cake to be stored & refrigerated until serving. I do not supply cake stands or tables.
Decorations:
Fresh flowers and/or inedible decorations may be used on your cake. You acknowledge that these items are not a food product and are not consumable.
Fresh flowers will have the stems taped or large bubble straws will be inserted, prior to the flowers being inserted into the cake. You acknowledge that fresh flowers may also contain pesticides, dirt and other contaminants. Lil’ Lady Cakes by Stacey will NOT be held responsible for any illness or injury.
Other inedible decorations may include but are not limited to - acrylic cake toppers, small toys, dried flowers, preserved flowers, silk flowers, chocolate coated Styrofoam parts, cake board, cake insert board, cake supports, dowels/large straws/skewers, acetate, inedible fabric lace, ribbon, balloons, candles (if supplied).
Furthermore, you acknowledge that some components of the cake such as edible sprinkles and/or other decorations may pose a choking hazard to small children. Therefore, it is your responsibility to supervise while these items are in reach of children, pets or adults. Client assumes full responsibility for making sure all nonedible cake décor, including but not limited to, sugar flowers, are removed from the cake before it is cut and served. Sugar flowers are made from edible materials, but are not intended for consumption as wires are added for strength and flexibility to achieve a more natural look. DO NOT EAT DÉCOR.
Alterations:
Any alterations to the size, style, flavour, decorations are only possible up until one (1) week prior to the final payment. Any changes may incur additional charges. No changes can be made after this time.
Cancellations:
Deposits are non-refundable however date changes may be acceptable - subject to my availability and ONLY if I receive more than two (2) weeks written notice as I have usually purchased materials & have started working on some components of your cake.
In the event that I am unable to fulfill your order due to illness, injury or emergency, I will refer you to other local cake decorators that will hopefully be able to assist you. In any of these cases, a full refund will be provided to you for any and all amounts which have been paid to me by you.
In the event that I cannot fulfil your order due to any acts of God or any other circumstances out of the control of Lil’ Lady Cakes by Stacey, you shall receive a full refund of any funds paid as long as it occurs two (2) weeks or more before your booking date. Inside this time frame the deposit &/or any funds already paid shall be forfeited.
Photos:
Lil’ Lady Cakes by Stacey reserves the right to take photos of the cake & any photos taken by myself remain the property of Lil’ Lady Cakes by Stacey and may be used for marketing purposes, demonstration and displayed on social media.
Upon collecting your cake, you will be required to sign a collection form that acknowledges that you (or the person collecting the cake on your behalf) have read, acknowledge & agree to these terms and conditions.
Within the first 24 hours:
If there are any problems with your order it is your responsibility to contact me ASAP. I will only except contact within the first 24 hours after pick up or delivery to discuss any problems that you may have with your order. I will try to help the best I can. If required to make repairs there will be a call out fee. Only the Client(s) or their event/wedding planners (made known to me) are authorized to place an order or make changes to the Agreement. No other individual (e.g., mother, father, mother-in-law, father-in-law, sibling, relative, friend, etc.) shall contact Lil’ Lady Cakes by Stacey directly regarding the order.
Lil’ Lady Cakes by Stacey is NOT liable for embarrassment, displeased guests, or any damage made to your order after pick up. There will NOT be any compensation or refund without any goods in return. Threats of any kind will not be tolerated and will be forwarded onto the appropriate authorities.
LIABILITY:
Lil’ Lady Cakes by Stacey is not liable for any harm or damage to your cake not caused me, property damage, guest injury, harm caused by eating inedible items or accessories, flower choices (poison, pesticides, dirt, poor handling), post pickup damage, and allergic reactions
