Terms and Conditions for the use of Red Kite Arena at Tunnel Hill Mews, Knock Lane, Blisworth, NN7 3DA (the “Arena”)
The below are the terms and conditions (T+Cs) for the use of Arena. These terms are incorporated into the contract for you to use the Arena and you are deemed to have accepted them either by signing a copy of them or by entering or using the Arena after these T+Cs have been drawn t
o your attention. We means Brandon Ransley and/or Alexis Warner as owners/operators of the Arena and the field in which the Arena is located (the surrounding area). We can be contacted on 07990 515141 (Alexis) and 07702 164643 (Brandon). You means you, the person making the booking and includes persons you are booking the Arena on behalf of. You are responsible to ensure that those you book the Arena on behalf of (including those under the age of 18) are aware of and comply with these T+Cs. Reference to horse shall be deemed to include pony. After paying for the costs related to the Arena including maintenance costs we make very little, if any, money from the hiring out of the Arena. For these reasons we are of the view that these T+Cs are fair and reasonable in all of the circumstances. If you do not find these T+Cs acceptable or reasonable we would rather you did not use the Arena and do not come onto the surrounding area. There will be no hard feelings. Horse riding can be dangerous
Horse riding is an inherently dangerous activity involving living animals and other riders. A horse (and its rider) may do things or take actions which are unpredictable, unexpected and/or surprising and which may cause danger to the horse, the rider and/or to other riders and horses. As such you must be aware that horse riding can result in injuries of varying severity. We draw your attention to the fact that the Arena is close to a private road. Noisy and/or fast vehicles might use this private road (even though we have, by signage, asked them to travel at 10mph or below and notified them that animals and children are present). Your Obligations
For your safety and the safety of others, you are required to, and agree to ,take all reasonable precautions to avoid and prevent any accidents occurring and separately to comply with the following when in the Arena or in or at the surrounding area:
On arriving at (and before using) the Arena you must contact Alexis or Brandon to let us know that you have arrived. You must at all times act responsibly and carefully in terms of yourself and others when using the Arena and the surrounding area and must not do, or omit to do, something which might put yourself or other persons or animals in attendance in danger. Before using the Arena you must ensure that you have surveyed the Arena and are satisfied that the facilities, the ground conditions and any jumps and fences and the lay out or set up are suitable for your use. If you consider that anything is dangerous and/or the Arena should not be used then please contact us and if we agree any money already paid for that use will be refunded. You are responsible for ensuring that all jumps and fences and fillers are suitable for the horse’s and rider’s ability. If you think that the jumps or fences or fillers are too high or wide or not suitable or their construction or maintenance is not safe then lower them to a safe height or move them to a safe place as appropriate. Please do not change the course design (save for spacing between doubles or triples to ensure that the striding is suitable and safe for your horse). Do not use the Arena if the weather or conditions are such that it may be dangerous to use, by way of example only, lightning or heavy rain. If we agree, any money already paid to us will be refunded. You must ensure that any rider (or other person) under 18 is under your supervision at all times (or the supervision of another responsible adult). You are responsible to ensure that all persons that you bring to the Arena and surrounding area are aware of their obligations under these T+Cs. Do not leave horses or children unattended. Do not enter the Arena when others are using it. Please stick to your allocated time slot and if others are waiting, exit the Arena before your time slot ends. At all times when riding or mounting a horse you must wear (and we recommend when loading/unloading and tacking up or otherwise handling a horse that you do wear) a properly fastened helmet complying with up to date British Showjumping and/or British Eventing standards. You must also wear appropriate footwear (for riders this includes a defined heel) at all times. We also recommend that you wear a body protector when riding a horse. All horses must only move through the surrounding area shared with pedestrians and/or vehicles at walk. No lungeing in the Arena without our express permission and no lungeing at all in the surrounding area. Do not use the surrounding area without our express permission. Be aware that permission will never be given to ride in the field in which cross country jumps are located and you must never enter this field. We do not have any insurance for you to use the cross country jumps and so it is prohibited. Clear up all horse droppings in the Arena (immediately) and in the surrounding area (before you leave) and put them in the wheelbarrow (if there) or take them home with you. Do not enter the Arena or the surrounding area while under the influence of (or use when at the Arena/surrounding area) alcohol or drugs (including prescription drugs which may impair your ability to ride or to be around horses in a safe manner). Do not bring a stallion or horse under 4 years to the Arena or surrounding area. If you do bring a dog to the Arena/surrounding area it is your responsibility to ensure that it is not in any way a danger to humans or other animals and that it is at all times controlled on a short lead. You must clear up and take away with you any dog “poop” your dog produces. An adult with a working mobile phone must always be in attendance when the Arena is being used. Lone riders must carry a working mobile phone. Do not smoke or use e-cigarettes in the Arena or surrounding area. Take your litter home with you. The parking area is relatively small. Please park tidily and take account of the needs of others. Please leave the Arena and surrounding area in a tidy state (at least as tidy as when you arrived). All horses must be vaccinated in accordance with our Vaccination Policy below. All persons who book the Arena to provide coaching or lessons or training to others must have their own valid public liability insurance of not less than £2m to cover the activities that they are doing. Please be aware that other people live in the area and so act courteously to people you meet in the vicinity. Save to the extent that we accept liability as set out below you will indemnify and keep indemnified us and each of our representatives, agents and employees (if any) against any and all losses, claims, actions, damages, liabilities and expenses including legal and other fees, that we suffer or incur as a consequence of you (or those persons for whom you have accepted responsibility under these T+Cs) not complying with their obligations as set out in these T+Cs. We reserve the right to require you and/or persons connected with you to leave the Arena and/or surrounding area in circumstances where we believe that you or they are creating a dangerous situation, riding in a dangerous manner, acting irresponsibly, mistreating a horse or not complying with your obligations as set out above. If we require you or any person with you to leave the Arena and/or surrounding area you/they must leave immediately. If you cause any damage to the Arena, surrounding area, jumps, fences or fillers or other equipment you must notify us before leaving. A charge will be made to you for repairs (or replacement) of any items damaged by you or the people attending with you or the horses you/they are riding (reasonable wear and tear excluded). Accidents and First Aid
You are responsible for your own First Aid and for those attending with you. Please note that we may not be in nearby when you are using the Arena or at the surrounding area. We do not provide first aid facilities or assistance. You must, therefore, bring your own first aid kit to treat any injuries. If there is an injury and you need medical assistance you must call the emergency services on 999. The best WHAT THREE WORDS to use are Downsize – Hacking – Slowness or use the address The Granary, Tunnel Hill Mews, Knock Lane, Blisworth NN7 3DA or the OS GRID Ref. SP7321952608. Every accident at the Arena or the surrounding area must be reported to Alexis or Brandon as soon as possible after the accident so that it can be recorded in the Accident Book. Our Liability and Exclusions
We do not seek to exclude or limit (and no provision of these T+Cs shall be deemed to exclude or limit) liability for death or personal injury resulting from our negligence (or that of our agents or employees (if any) for whom we are responsible). We do exclude liability for, and shall have no liability whatsoever for, the following whether or not caused by our negligence or breach of contract or otherwise:
Death or injury to any horse or any other animal. Damage to any vehicle, equipment, possessions or other property. Theft of any horse, vehicle, equipment, possessions or other property. Any loss of profit, special or indirect loss, pecuniary loss or consequential loss. Any loss or corruption of data, databases or software. You should have your own equine and other insurances to cover any such loss mentioned in paragraph B above. Vaccination Policy and Health of Horse
Any horse visiting the Arena must arrive with an original passport showing a vaccination or booster against equine influenza within the last 6 months and 21 days. Any horse arriving without an original passport, showing an out of date vaccination or booster or if the booster has been given in the 7 days immediately preceding arriving will not be permitted into the Arena and will be asked to stay on the lorry and to leave. If your horse is showing any symptoms of illness please do not bring it to the Arena. The Legal Bits
If any court or competent authority finds that any provision(s) or part of any provision(s) of these T+Cs is or are invalid, illegal or unenforceable that provision(s) or part provision(s) will, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions or remaining part of the provision(s) of these T+Cs will not be affected. The Contracts (Rights of Third Parties) Act 1999 shall not apply to these T+Cs and no third party will have any right to enforce or rely on any provision of these T+Cs. These T+Cs and the booking form together contain the whole agreement between you and us relating to the hire of the Arena. These T+Cs and our agreement is governed by and interpreted by the laws of England and Wales and all disputes (including non contractual disputes) shall be subject to the exclusive jurisdiction of the courts of England and Wales.
