XL Bully Ban - Update to your Insurance Policy


Further to our previous email regarding the XL Bully Ban, we have updated our wording, which includes the conditions for dogs on the DDA and can be found on page 22. Please find attached. This will be effective with immediate effect.



We have been inundated with a lot of trade specific queries and whilst we cannot advise on government rules, we have tried to provide some guidance below, which allows your business to continue to grow and flourish, but in a safe environment.



There will always be situations and scenarios that have not been mentioned, but ultimately, in the event of a claim, each case will be dealt with individually on its own merits.



DOG WALKERS

As your insurer, you will be covered to walk an XL Bully Dog on the following basis:

The dog is registered with the index of exempted dog (IED) and a copy of the life certificate is obtained and provided to us in the event of a claim.
A copy of the public liability insurance certificate for the dog is obtained and provided to us in the event of a claim.
The dog handler ratio is 1:1 with their handler at all times
The dog is Neutered – in line with Government terms
The dog is Micro Chipped
The dog is kept on a lead and muzzled at all times – in public
If you are walking on a 1:1 basis in a privately rented secure field, you may remove the lead and muzzle on the following basis:
The field must be private property with no public access passing through
The field must be securely fenced and locked so the dog cannot escape
The dog is kept on a lead and muzzled until the gate is shut when entering the field
The dog is put back on a lead and muzzled before opening the gate to leave the field
If there is more than one dog from the same household, they can come to the field together, but the banned breed dog must have its own handler and then another handler needs to be present to supervise the other dogs. If there is more than 1 banned breed in the household, they can come together but each dog must have their own handler.


FIELD HIRE

As your insurer, you will be covered to hire out your private fields for an XL Bully Dog on the following basis:

The dog is registered with the index of exempted dog (IED) and a copy of the life certificate is obtained and provided to us in the event of a claim.
A copy of the public liability insurance certificate for the dog is obtained and provided to us in the event of a claim.
The dog handler ratio is 1:1 with their handler at all times
The dog is Neutered – in line with Government Rules
The dog is Micro Chipped
The field is private property with no public access passing through
The field is securely fenced and locked so the dog cannot escape
The dog is kept on a lead and muzzled until the gate is shut when entering the field
The dog is put back on a lead and muzzled before opening the gate to leave the field
You can remove the lead and muzzle once inside the secured field


If the household has more than 1 dog, they can come to the field together, but the banned breed dog must have its own handler and then another member of the same household needs to be present to supervise the other dogs. If there is more than 1 banned breed in the household they can come together but each dog must have its own handler.



DOG TRAINERS / BEHAVIOURISTS

As your insurer, you will be covered to train an XL Bully Dog in a group class on the following basis:

The dog is registered with the index of exempted dog (IED) and a copy of the life certificate is obtained and provided to us in the event of a claim.
A copy of the public liability insurance certificate for the dog is obtained and provided to us in the event of a claim.
The dog handler ratio is 1:1 with their handler at all times (this can be yourself, a member of staff or the owner aged over 18)
The dog is Neutered – in line with Government Rules
The dog is Micro Chipped
The dog is kept on a lead and muzzled at all times in public and classes
If you are providing the training on a 1:1 basis at the customers home or a privately rented secure field where the dog cannot escape from, the dog is not required to be on a lead or muzzled.


HYDROTHERAPISTS / GROOMER

As your insurer, you will be covered to provide hydrotherapy to an XL Bully Dog on the following basis:

The dog is registered with the index of exempted dog (IED) and a copy of the life certificate is obtained and provided to us in the event of a claim.
A copy of the public liability insurance certificate for the dog is obtained and provided to us in the event of a claim.
The dog handler ratio is 1:1 with their handler at all times
The dog is Neutered – in line with Government Rules
The dog is Micro Chipped
The dog is kept on a lead and muzzled at all times when arriving at your complex
The dog is treated on your private property and is secured and cannot escape
You can remove the lead and muzzle if necessary whilst the dog is in the water as long as you feel comfortable with this


KENNELS

As your insurer, you will be covered to kennel an XL Bully Dog on the following basis:

The dog is registered with the index of exempted dog (IED) and a copy of the life certificate is obtained and provided to us in the event of a claim.
A copy of the public liability insurance certificate for the dog is obtained and provided to us in the event of a claim.
The dog handler ratio is 1:1 with their handler at all times
The dog is Neutered – in line with Government Rules
The dog is Micro Chipped
The dog is kept on a lead and muzzled at all times when arriving and leaving your kennels
The dog is kept separately in a kennel of its own
If at any point the dog mixes with other dogs, it must be kept on a lead with a muzzle and a 1:1 handler
You must check with your local council that your licence allows you to board banned breeds
If walking an XL Bully, you must comply with the dog walker rules above


HOME BOARDING

As your insurer, you will be covered to board an XL Bully Dog in your home on the following basis:

The dog is registered with the index of exempted dog (IED) and a copy of the life certificate is obtained and provided to us in the event of a claim.
A copy of the public liability insurance certificate for the dog is obtained and provided to us in the event of a claim.
The dog handler ratio is 1:1 with their handler at all times
The dog is Neutered – in line with Government Rules
The dog is Micro Chipped
The dog is kept on a lead and muzzled at all times when arriving and leaving your home
The dog can be off lead and unmuzzled whilst in your private home
You must check with your local council that your licence allows you to board banned breeds
If walking an XL Bully, you must comply with the dog walker rules above.


DOG DAYCARE

As your insurer, you will be covered to have an XL Bully Dog in your Daycare facility on the following basis:

The dog is registered with the index of exempted dog (IED) and a copy of the life certificate is obtained and provided to us in the event of a claim.
A copy of the public liability insurance certificate for the dog is obtained and provided to us in the event of a claim.
The dog handler ratio is 1:1 with their handler at all times
The dog is Neutered – in line with Government Rules
The dog is Micro Chipped
The dog is kept separately in a room of its own
If at any point the dog mixes with other dogs, it must be kept on a lead with a muzzle and a 1:1 handler
You must check with your local council that your licence allows you to facilitate banned breeds
If walking an XL Bully, you must comply with the dog walker rules above


PET SITTING / PET MINDING

As your insurer, you will be covered to pet sit or pet mind an XL Bully Dog on the following basis:

The dog is registered with the index of exempted dog (IED) and a copy of the life certificate is obtained and provided to us in the event of a claim.
A copy of the public liability insurance certificate for the dog is obtained and provided to us in the event of a claim.
The dog handler ratio is 1:1 with their handler at all times
The dog is Neutered – in line with Government Rules
The dog is Micro Chipped
The dog is kept on a lead and muzzled at all times when in public
The dog can be off lead and unmuzzled whilst in the customers private home
If walking an XL Bully, you must comply with the dog walker rules above.
You must check with your local council that your licence allows you to board banned breeds

As your insurer, you will be covered to provide a pet taxi service for an XL Bully Dog on the following basis:

Statement
The Government is taking urgent action to bring forward a ban on XL Bully dog types following a concerning rise in attacks and fatalities, which appear to be driven by this type of dog.
Under the Dangerous Dogs Act 1991, a definition of the ‘American XL Bully’ breed type needs to be specified in order to impose a ban. The Environment Secretary and the Home Secretary will convene experts to define the ‘American XL bully’ breed type. This group will include police, canine and veterinary experts, and animal welfare stakeholders. This is a vital first step towards adding it to the list of dogs banned under the Dangerous Dogs Act. We will engage with the relevant devolved administrations about adopting a UK-wide approach.
The Government will then legislate to add it to the list of dogs banned under the Act. I intend to have the legislation in place to deliver this ban by the end of the year. This will make it an offence to own an unregistered XL bully, or to breed, gift or sell one. We need to safely manage the existing population of these dogs, therefore there will be a transition period. Further details on how this period will work will be provided ahead of the tabling of the legislation later this year. Dog owners do not need to take any action at this stage.
We have been working hard with the police, local authorities and animal welfare groups to help prevent attacks by encouraging responsible dog ownership, to ensure dog control issues are addressed before they escalate and to make sure the full force of the law is applied. Owners whose dogs are dangerously out of control are already breaking the law, and we already have a full range of powers to apply penalties to them. Under the Dangerous Dogs Act, any dog that is dangerously out of control can be euthanised and their owners put in prison for up to 14 years and be banned from ever owning a dog.
While the courts have the power to allow people to keep banned breeds with certain conditions, like being muzzled and neutered, the number of so-called exempted dogs is higher than a decade ago. That was not the intention of the legislation passed over 30 years ago. Therefore, we will also review our guidance to enforcers of the law.

Imagine having a dog that can't function outside without knowing where their ball is. Here is how that can happen to reactive dogs.
There are physical and emotional health issues surrounding the repetitive action of throwing a ball for your dog, especially if that's with a ball launcher and they are doing it excessively.
Sensory pain has an emotional component working in tandem to provide information to the nervous system. Therefore repetitive movements causing physical health issues can give rise to compulsive behaviour, as a coping strategy, animal utilises what's in their environment to regulate emotionally when they are chasing a ball exclusively, which increases the intensity of the behaviour and can easily lead to compulsive tendencies.
Compulsive ball behaviour in reactivity can be massive. Owners use the ball to prevent barking. If the ball is in their mouth and they are quiet, they must be okay, right? Wrong!!
The dog is suppressing reactive behaviour; it's aversive to be prevented from doing the thing every fibre in your body is telling you will keep you safe (barking at the scary trigger to make it go away). It causes conflict because they desperately want to keep hold of the ball, and now we may create resource guarding too.
This pattern increases unhealthy ball obsession behaviours, too, as the dog learns to focus on that ball more and more to make themselves feel better about concerning situations they are being put in more frequently because the owner thinks they have solved the reactivity problem for the dog.
In reality, that problem becomes increasingly internalised, allowing the development of stereotypical and compulsive behaviour or increasing its intensity.
Play fetch with your dog, but not exclusively, ensuring you protect their physical health while doing so, with warm-ups, breaks in-between and ditch the ball launcher.
Don't use the ball as an alternative to meeting their emotional needs, i.e so you can put them in situations they find concerning, instead of helping them feel safe, so they aren't worried in the first place. It will backfire!

So what's the deal with dog on dog attacks? ❓️
Did you know that under the current legislation, it isn't an offence for a dog to attack another dog unless they're a certified assistance animal.
So what does that mean for the owners of these poor pooches?
* * * * * * * * * *
❓️ What can the council do? ❓️
Firstly, we'd like to remind everyone that under section 3(1) of the Dangerous Dogs Act 1991, it's an offence for any dog to be dangerously out of control, whether or not in a public place.
With that being said, dog on dog attacks fall into 2 categories which are listed below.
1. Both dogs are off lead
- This is a civil matter only as both dogs could be considered dangerously out of control.
2. An off lead dog approaches an on lead dog resulting in an attack.
- The off lead dog is always at fault regardless of age, s*x, or breed. Though they may not have been the aggressor, in the eyes of the legislation they are the ones that were 'out of control'. Realistically, if they'd been on a lead there's a high likelihood the incident wouldn't have taken place.
The council can only become involved in scenario 2 and will only take additional action against the off lead dog, not the on lead one.

❓️ So what's meant by dangerously out of control? ❓️
It's often assumed that only large breeds can be considered 'dangerously out of control', but this is a broad definition which covers dogs of any size, age and breed. This means a Chihuahua can just as easily fall into this category as a Doberman.

❓️ Can the council help recoup vet bills?❓️
No. You'd need to take your own action by going through small claims court.
