We've mentioned this before but we still see a number of scams involving companies trying to sell you an “ESA tag,” “ESA ID,” “ESA vest,” “ESA certification,” or an “ESA registration.” These types of documents are NOT legal documents that Texas landlords and apartment complexes are required to honor according to HUD, the ADA, and the FHA. As a renter in the Dallas/Ft. Worth area, it’s critical to know your rights, especially if you find yourself suffering from various mental health ailments such as depression, loneliness, anxiety, PTSD, bereavement, or other issues. If you are, you might qualify for keeping an emotional support animal or ESA with you while you are renting. Your right to have an emotional support animal in Dallas/Ft. Worth is federally protected by the ADA (Americans for Disability Act), HUD (Housing and Urban Development), and the FHA (Fair Housing Act). And Dallas/Ft. Worth landlords, by law, cannot refuse to let you house an emotional support animal, assuming you have a letter from a licensed mental health professional (LMHP). Unlike a service dog, an ESA or Assistance Animal does not have to be specially trained. It can be almost any type of animal (dog, cat, bird…etc.), and a person can have more than one emotional support animal. An ESA helps improve a person’s mental health by living with and accompanying them as a comfort animal. While a service dog can go to public places, an ESA might not necessarily be allowed into public places (like stores or gyms) unless the owner/manager of the location grants permission. Typically, most services charge twice as much, and they may charge for each animal, item, or need. Because I don’t charge for each item, and our fee is more affordable, we serve most Texans, regardless of their ability to afford help. Psychiatric service dogs are defined as dogs that are individually trained to perform tasks for people with a mental health disability. The trained task needs to be directly related to the person’s disability. The animal does not qualify as a service animal if its sole function is to provide comfort just by being present. A few examples of psychiatric service dog tasks might include: medication reminding, alerting you when you are distressed, performing safety checks to alleviate fears for those with PTSD, or intervening during a person’s self-destructive behavior. A psychiatric service dog is specifically trained, by yourself or a professional, to complete a task or attend to a need related to a mental health disability. The dog might respond to a command, or sense a need (such as a panic attack), and then perform an action (such as nuzzling, laying on the person, etc.). PSA’s or psychiatric service dogs are allowed to accompany you to most public places, such as stores, planes, gyms, etc. On the other hand, an ESA or Assistance Animal does not have to be specially trained, can be any type of animal (cat, bird…), and a person can have more than one emotional support animal. An ESA helps improve a person’s mental health by living with and accompanying their person as a comfort animal. While a service dog can go to public places, an ESA might not necessarily be allowed into public places (like stores or gyms) unless the owner/manager of the location grants permission.

ESA or service dog letters are primarily designed to prevent discrimination when it comes to bringing an animal home to an apartment or rental. But the law recognizes other benefits for service dogs in particular, including public places such as restaurants, hotels, and airlines. For the latter three areas (public places, hotels and airlines), it can be up to the establishment or airline to recognize ESA letters. Some certainly will do so, but others may not.
