What we need: H**p keepers and others opposing this overreaching proposal should call in and voice their opposition on Thursday, February 25. Our topic should be discussed between 9:30 and 11:00. After FWC staff presents their material, the line will be opened for callers. Simply dial the number and enter the code that will be shown on your screen. For those stating they oppose the ban, asking this matter to be tabled, and requesting a dedicated TAG meeting on the matter, give the ones with longer comments a chance to enter the caller queue first. What is happening:

All of these species (including all morphs) will be banned and listed as Prohibited Species:

​

Green iguana (Iguana iguana)
All Tegus (genera Salvator and Tupinambis, all species)
Reticulated python (Python reticulatus)
Indian and Burmese python (Python molurus and Python bivittatus)
Northern African python (Python sebae)
Southern African python (Python natalensis)
Amethystine python (Morelia amethistinus)
Scrub python (Morelia kinghorni)
Green anaconda (Eunectes murinus)
Nile monitor (Varanus niloticus)

Prohibited Species means all of the below for the species above:

​

No future pets: people with "pets" at the effective date can have them grandfathered (see below).
No breeding (see minimal allowances below for tegus and green iguanas ONLY).
No Florida sales.
Must allow FWC to inspect animals and enclosures.
The current Conditional Species Program (CSP) will be gone for all currently CSP-listed reptiles except red-eared sliders (for which breeders have aquaculture permits from the Department of Agriculture and are not regulated by FWC, anyway.)

For green iguana and tegu breeders and businesses: VERY limited breeding SUNSETTING clause: This is no longer the grandfather clause that FWC reported last year:

Businesses or breeders with green iguanas and/or tegus on their FWC inventories can continue producing animals ONLY until June 30, 2024. Breeding must end much sooner (see #2).
"Any eggs produced after June 30, 2024 shall be destroyed immediately." - FWC
NO breeding outdoors and all other outdoor activities prohibited (see rules).
Businesses must submit an annual report.
All animals over 5 inches snout-to-vent length (SVL) must be PIT-tagged.
No importation.
Comply with new caging and other standards.

For Conditional Species breeders and businesses for CSP-listed constrictor snakes and Nile monitors:

You will be given no consideration and no avenue to continue breeding.
We do not yet know if FWC will even allow you to keep any of your animals as non-breeding pets.
You will have to export, euthanize, or surrender them before the deadline set by FWC (date not yet posted by FWC).

For limited commercial sales of green iguanas and tegus only: VERY limited SUNSETTING clause: This is no longer the grandfather clause reported last year:

You are eligible only if you held a valid captive wildlife class III exhibition or sale license on June 30, 2020, with a documented inventory or planned possession of green iguanas or tegus on his or her or its 2018 or 2019 license.
No importation.

For tegu and green iguana pet owners: Animals must be:

PIT-tagged (passive integrated transponder AKA microchip)
registered with FWC
possibly inspected by FWC

There will be limited exemptions allowing continued exhibition for animals currently owned (no future animals possible unless you have a permanent, public facility that is not a residential dwelling).
Applicants must provide proof for a minimum of 12 educational engagements equating to a minimum of 48 hours of public exhibit contact time annually.

About the Conditional Species Program (CSP) where we would these species to remain or be added rather than Prohibited:

​

Permitting is a high bar. This is the most restrictive regulation in the U.S. Private parties who want to keep Conditional Species are held to the exact same regulation as big Association of Zoos and Aquariums (AZA) accredited zoos. To reiterate, private parties must have caging and facilities as secure as those in accredited zoos.



The CSP Program includes the following:

strict caging requirements;
escape-proof caging;
locking/latching cage/room requirements;
buildings housing Conditional Reptiles must be concrete-floored and anchored;
signage requirements including β€œDanger – Dangerous Reptiles” posted on entry doors;
cages must be labeled with common and scientific names;
all animals must be microchipped with a unique passive integrated transponder (PIT tag);
PIT Tag implantation shall be in specimens with one inch or greater diameter and in the rear 1/3 of the body;
record of identification including PIT Tag number must be reported to FWC within 72 hours of acquisition and maintained in the possessor’s records;
Conditional Reptile species held in captivity are subject to inspection by FWC at any time;
violations must be corrected within 30 days or permit can be revoked;
inclusion of critical incident disaster plan;
inventory, birth, death, sales records/reports accessible by FWC at any time;
transportation regulations;
records of acquisitions;
transfers must be accompanied by FWC forms/submissions;
annual permit.

For those who do not like snakes, lizards, or "invasive species"

​

We understand that many believe the false reporting from most media and are not fully informed about these animals or the current regulations in Florida. For over a decade, some reptile species have been heavily regulated by FWC under the Conditional Species Program. This regulation requires that anyone desiring to keep these species must abide by the exact same regulations and standards that accredited zoos must follow. Heavily regulated is an understatement!

This proposed regulation fails to properly address current invasive species issues while being fully effective at punishing responsible citizens. Rather than working to resolve problems and punish criminals, FWC is working to enact unjust rules and has turned to bias against good reptile keepers.

Forget that this situation involves snakes and lizards. Imagine your government telling you that something you have done conscientiously for over a decade is now illegal. Imagine your government telling you that your million-dollar investment was all wasted time and money. Imagine your government telling you that your family’s future and stability are now in jeopardy. That is the story of what is happening. This is not about stopping potentially invasive species from establishing in Florida. It is about overreaching policy based upon tyrannical ideology trumping logic and common sense.

The draft rules regarding nonnative reptiles (tegus, iguanas, Conditional Species) have been posted to the Florida Administrative Register today (Sept. 14, 2020). FWC will be holding 10 public workshops via Zoom beginning Sept. 29 (dates and times will be posted soon). The draft rules are scheduled to be presented to the Commissioners at the December 16-17 Commission Meeting.

USARK FL Got It Done!

It was a good day! Mid-afternoon on September 3rd, Circuit Judge John C. Cooper ruled from Tallahassee, Florida, that USARK FL was correct in its challenge that Senate Bill 1414 (SB1414) violated the Florida Constitution. The legislative bill that was signed into law by Governor Ron DeSantis banning tegus and green iguanas as pets, as well as terminating the successful Conditional Species Permit (CSP) program for reptiles, will now be repealed. In short, we argued that SB 1414 was unconstitutional, and the Court agreed!

The legal process must still be completed but over the next week or so we will see a written Order from Judge Cooper. To be clear, Judge Cooper has granted our motion for summary judgment and we await the formal Order reflecting his decision. Following that, FWC will have 30 days to appeal. If FWC does not appeal, then it will rescind its Executive Order 20-19. When that occurs (which may happen prior to the 30-day deadline), Florida h**petoculturists and businesses will be able to conduct the same activities they could prior to July 1st of this year, when SB1414 became law.

While the Court has ruled in our favor, we suggest that businesses and h**p keepers wait for all formalities to be completed. We will be sure to keep the h**petoculture community apprised on updates.

Note that by "unconstitutional" we speak of the Florida Constitution, not the U.S. Constitution. This is a state lawsuit against a state agency involving a state statute, not a federal lawsuit.

While we had a huge victory in court, we must now focus on the FWC rulemaking. FWC has started their rulemaking process regarding tegus and green iguanas, as well as possible elimination of the CSP program. But this is not over yet. Our lawsuit does not make the initiated rulemaking go away. However, it does mean that the regulations do not need to mirror SB1414.

FWC cannot rely on the legislature’s mandate to pass bans. FWC must now create β€œreasonable rules.” We will work for a regeneration of the cooperative spirit that once existed between FWC and stakeholders. We all want to protect Florida’s environment and fauna. That is a top priority. We must not lose sight that common-sense and reasonable regulation is a far more productive and protective path than bans. Anyone who thinks bans are the answer should have paid more attention in history class.

Please know that this victory does not mean that you should go buy a tegu or iguana β€œbefore it’s too late.” These species are long-lived and bringing one home should be taken very seriously. That little cute baby will grow quickly. Tegus and iguanas require exceptionally large enclosures, lots of food, specialized UVB lighting or daily exposure to natural sunlight, and much more attention and care than other reptile species. Bringing a tegu or iguana into your home necessitates nearly as much responsibility as a dog or cat. Be responsible! If you are not willing to keep that animal humanely for its entire life, then you should not bring it home. If you do not have the resources to care for a tegu or iguana properly and responsibly, then please do not buy or rehome one.

One final point… while this lawsuit dealt with Conditional Species, tegus, and green iguanas, this was a win for all conscientious h**petoculturists and animal enthusiasts. This lawsuit was for the entire community. We had to take a stand. We did that… and we prevailed!
