The more things change (Colin Kaepernick’s take-a-knee that cost him dearly) the more they stay the same (Jackie Robinson’s defiant lament, ”I cannot stand and sing the anthem” ).
Every few decades the racial discrimination issue bubbles up to the front of public consciousness and then that inconvenient truth is soon reburied.

Maybe we’d be reflecting more on his lament, “I cannot stand and sing the anthem.”

Help the Brooklyn Lyceum get DUE PROCESS from two judges up for re-election on Nov 5, 2019 who have not acted smarter than a 5th grader by signing a couple of affidavits that show you are smarter than a 5th grader, something those two judges have, as yet, failed to show. Judge Reinaldo Rivera, in shades of Indiana circa. 1897 attempting to legislate pi as 3.2, found that October 19 comes after October 26. Judge Donald Scott Kurtz granted a motion in 2011 when the Notice of Motion said the hearing was in 2001. Pretty stupid, and, if all the legal prof's we have consulted are right, this type of dumber than a 5th grader-isms lead to the inevitable unwinding of the sale of the Brooklyn Lyceum. --Then you are ready to speed up the Return of the Brooklyn Lyceum because the unavoidable issue is that the courts (lower and appellate), in an ill advised attempt to short circuit due process for the Brooklyn Lyceum (made up facts, altered docket for plaintiff, partial quoting of caselaw), created a winnable battle.

Catch-22 and Kobayashi Maru ….

Alternative phrases for no good answer for the situation.

—Catch-22, from the book of the same name by Brooklyn (Coney Island ) native Joseph Heller, describing the wartime problem of any choice you make having a bad result, and

—Kobayashi Maru from Star Trek II - The Wrath of Khan, an extreme where one choice results in the death of hundreds of people you don’t know and the only other choice kills you and all those with you.

With regards to the Brooklyn Lyceum, the courts are to be soon presented with such a choice:
--rule one way and the sale of the Brooklyn Lyceum must be unwound and smack the Plaintiff with a dozen whacks from a clue stick, or,
--rule the only other possible way and the sale of the Brooklyn Lyceum must be unwound and smack the Plaintiff half a dozen times with the clue stick.

To that end we are intrigued as to how many ways you can describe a no-win situation.

How is it that Magistrate Judge Henry Pitman and AUSA Stephanie Lake can hear an officer testify that he arrested Lidya Radin and yet not make sure that the judges decision on a pretrial motion premised on the AUSA stating (not under penalty of perjury) that "As an initial matter, the defendant at no time was placed under arrest" be vacated su sponte?

Blink Park Slope on the Brink: Slipshod attorney at Herrick and Feinstein (Avery S. Mehlman) may lead to Blink eviction from the Brooklyn Lyceum ( www.brooklynlyceum.com ).

At a hearing at the NYC Buildings department yesterday, it became clear that Greystone incented Blink Fitness to occupy more of the Brooklyn Lyceum (and its new floor) than is allowed under the 1943 Certificate of Occupancy.

Rather than file for a new Certificate of Occupancy for a cellar, a first floor and a second floor, the Ni**od Warship Greystone somehow got the NYC Buildings Department inspector to sign off on a new floor and occupancy contrary to the existing Certificate of Occupancy.

All this is just a long winded way of explaining that there may be no win for Blink at the Brooklyn Lyceum. They can only have 80 people in the cellar (where the tiny workout room is and 30 people in the locker rooms and NO USE ON FIRST OR SECOND FLOOR.

Yup, Blink cannot use the new first floor or even the second floor.

Despite my ridiculous May 10, 2017 arrest orchestrated by Eastern District of New York Chief Bankruptcy Judge Carla Craig, there is yet another appearance before Judge Craig.
The appearance is on Tuesday July 18, 2017 at 11AM. This is where we will again make a record of the malfeasances of the court such that the court must, as per the following law, report it to higher authorities or be guilty of a felony.
18 U.S. Code § 4 - Misprision of felony : Whoever, having knowledge of the actual commission of a felony cognizable by a court of the United States, conceals and does not as soon as possible make known the same to some judge or other person in civil or military authority under the United States, shall be fined under this title or imprisoned not more than three years, or both.
We think that a few watchers would be helpful to document the situation.
