1/12/24 update! Many of our flower products were released from the administrative hold tonight in the MMCP’s mass re-testing effort. These items including Mockingbird’s premium 1/8s and 7g and 14g bags will be available again in dispensaries tomorrow. A federal appeals court has found the enforcement of a long-standing law unconstitutional, which bans firearm ownership for individuals who use illegal drugs, as it infringes upon their Second Amendment rights.

This ruling, announced on Wednesday, August 9th, centered around the case of Patrick Daniels, a cannabis user. In April 2022, during a routine traffic stop in Hancock County, Mississippi, law enforcement discovered a handgun, a semi-automatic rifle, and ma*****na cigarette remnants in Daniels’ vehicle. Although the U.S. Drug Enforcement Administration did not conduct a drug test, Daniels openly admitted to using cannabis, which is against federal law.

Under 18 U.S. Code 922, also known as “Unlawful acts,” Daniels was sentenced to nearly four years in prison for violating the law that lists prohibited firearm-related actions.

However, a panel of three judges from the 5th U.S. Circuit Court of Appeals in New Orleans, Louisiana, concluded that the federal law violated the constitutional rights of a Mississippi resident to possess and carry fi****ms.

The conflict between state and federal ma*****na laws has created a complex legal situation that can affect people’s rights, especially their right to own guns. According to federal law, individuals who use cannabis are not allowed to possess fi****ms, even if it’s legal in their state. This puts gun owners who use cannabis, whether for recreation or medical purposes, in a tough spot. They may have to choose between keeping their fi****ms or consuming cannabis.
