The notice "DOFAWM-072622" regarding intention by the State of Hawaii to conduct animal control activities beginning 8-18-22, specifically "aerial shooting from helicopters for feral cattle and feral pigs within the Hana State Forest Reserve, Koolau State Forest Reserve (Upper Hana Section), and Hanawi NAR, for feral cattle, feral pigs, deer and feral goats within the Kipahulu State Forest Reserve (Manawainui Section), Kahikinui State Forest Reserve and Nakula NAR, and Koolau State Forest Reserve (Honopou Section)"; is considered usufruct, a violation of the Laws of Land Warfare amidst the ongoing occupation of Hawaii. If the State of Hawaii, the occupying state, proceeds with their intention to conduct aerial animal eradication, these violations to International Law will be intricately documented and reported to Mr. Karim Khan and his deputies who serve in the Office of the Prosecutors at the International Criminal Court.

We are remitting this correspondence to formally convey firm opposition to the proposed aerial eradications, these objections being put forth by the Council of the Chiefs of Hawai‘i East Maui Haleakala chapter who are descendants of the Hawaiian people who inhabited the metes and bounds of this geographical location prior to 1778. At the very least, an eradication objective overview, an environmental impact statement and a public input process is warranted before conducting such invasive aerial eradication plans that could pose damage to the aboriginal people; their cultural resources and lands that provide for their substance lifestyle needs. The animal eradications are considerably an attack on the food supply of the Hawaiian people. Aerial animal eradication en mass would leave thousands of dead animals in the wild and create an environmental intoxication issue which is counterproductive to the claimed motive of land conservation.

Article 55: The occupying State shall only be regarded as administrator and usufructuary of the public buildings, real property, forests, and agricultural works belonging to the hostile State, and situated in the occupied country. It must protect the capital of these properties, and administer it according to the rules of usufruct. Article 56: The property of the communes, that of religious, charitable, and educational institutions, and those of arts and science, even when State property, shall be treated as private property. All seizure of, and destruction, or intentional damage done to such institutions, to historical monuments, works of art or science, is prohibited, and should be made the subject of proceedings. We are writing to notify you of the fact that the various parcels listed below (otherwise identified by their TMK numbers for your convince of comprehension), are under cultural safeguard through tenancy and exercise of subsistence activities by their respective ahupua‘a tenants. We are communicating our awareness of civilians who live countryside within these parcels and also in the vicinity of these parcels, who do not have access to media nor do they receive the newspaper to have been thoroughly made aware of the intention by the State of Hawaii to conduct aerial shooting, and that such operations by the State of Hawaii would pose risk to human life and habitation, and would undoubtedly violate the rights of the Hawaiian people and cause harm to their land which they still depend upon for their survival. Aerial shooting by the State of Hawaii would particularly threaten the customary traditions and subsistence lifestyles of the Hawaiian people, and would conflict with their cultural and religious rights.

Cease and desist your intention to conduct aerial eradications in the following areas:
Hamakuapoko, Hamakualoa, Ko‘olau, Hana, Kipahulu, Kaupo, Kahikinui, Honua‘ula, and Kula moku on the island of Maui, HAWAI‘I.

I strongly object to your recent decision
to grant a Right Of Entry (ROE)
to eradicate animals from the
Kahikinui Homestead. The outfits
selected to conduct such work have
poor work history and are unfamilair with
the region. The organization that presented this said plan do not represent the homestead and have failed in their beneficiary reach. They only have six voting members in the organization. There are over 70 homesteaders that must be afforded the opportunity to weigh in.

Please rescind the ROE and afford science-based, experiential based field experts to deliver sound plans that better protect Homesteaders and our fragile forest.

The Department of Hawaiian Home Lands (DHHL) Maui District Operations Manager retired at the end of last year (2021). The issue of Kahikinui animal management was not complete prior to her leave. This inquiry correspondence was constructed and delivered to DHHL Homestead Services Administrator Juan Garcia because Kapaku's position has not been filled to date.

At the monthly meeting of June 21, 2022 a premature request for Right Of Entry (ROE) was made to Department of Hawaiian Home Lands Commissioners. It was an unfortunate display of commercial interests. The issue regarding animal management in Kahikinui has been a serious issue for the last four years.
Here is the first correspondence delivered to Maui Commissioner Randy Awo, his co-workers and the Department of Hawaiian Homelands Chair William Aila.
