Thank you for deciding to make one of our puppies the new edition to your family. We want to make this a stress free, enjoyable experience for you. However, because puppies are usually acquired years apart by people, and sometimes it is their first pet ever, knowing what to do or expect can be confusing. It can be stressful to face the unknown, so this health guarantee and adoption agreement are designed to cover the areas of the most common, possible, and even a few unlikely scenarios that could arise in a breeder/new family transaction of a puppy. As you read through this, please do not let all the possible scenarios alarm you, instead be reassured through this written out and signed agreement, that we will both know what to expect from each other in almost any given situation I literally typed out anything I could think of or have heard of from other breeders or the vet’s office to try to be thorough what I think we should do in any possible scenario. Please feel free to email or call me with any questions, concerns or sections that you feel need to be modified to fit your situation better because I am flexible to change things according to your needs as long as it is in line with all of our best interest (but the puppy's best interest most of all).
Your puppy is raised inside my home with the Mom, myself, my children, and my other dogs and cats. My Goldens are our family pets and other than running around our two acres freely at will by going to the back door to be let out, they stay indoors with us. The puppies will remain indoors until weaning at 6 weeks of age, where they are moved to a temperature-controlled garage at night and are allowed to go outside on the front porch and in the courtyard to play if the weather permits. If it is too cold or too hot they only go outside for potty breaks for a few minutes. They are crate trained at night only after six (6) weeks. We recommend you continue crate training until at least fully potty trained. We also recommend baby gates to enclose them in the area you choose if they were to have an accident. They are only corrected for going potty inside if I actually see who did it. So we call that partial potty training because the others watch and learn too. We recommend a doorbell if you do not have a doggie door. It has been the quickest way from our experience with past buyers to potty train successfully. They learn quickly if they know to ring the bell and you will come and let them out immediately. Standing at the door and scratching can be missed so they will inevitably fail if not quickly let out, revealed by a mess on the floor.
As we go through this process of waiting for your puppy to become eight (8) weeks old, I will keep you up to date with information about your puppy as it grows until it is time for your puppy to go home with you. I will update you with three pictures and one video every two (2) weeks once you have chosen your puppy. We are proud of the smiling, healthy puppies these parents produce. Please read the health guarantee completely before putting a deposit on a puppy. By putting a deposit on a puppy, you are agreeing that you read this document and the Health Guarantee and that you agree to the terms and conditions here within this agreement between the buyer and seller.
TERMS AND CONDITIONS:
1. Seller requires a five hundred dollar ($500.00) deposit to secure either position on the order of getting to pick a puppy or if after they are 6 weeks of age, it can be applied to a specific puppy after others who placed deposits early have chosen their picks already. Once you actually pick the specific puppy at 6 weeks or later, and are given the microchip number of a specific puppy you chose, the puppy is then placed on hold and no longer available to any other buyers and the deposit becomes non-refundable at that point. The purpose of this is to not accept any deposits on a puppy that for some reason may not pass a health check, so we wait until we know they are without any health issues and are deemed healthy for sale by my licensed veterinarian before allowing picks of a specific puppy at 6 weeks. Prior to getting puppy health checks, buyers may only place a deposit for the order that they will get to choose their specific puppy after health checks. Once a buyer chooses their specific puppy at 6 weeks or later, the buyer then receives the last four (4) digits of puppies microchip number of their specific puppy. The microchip will be used for verifying which is their puppy to place a hold on. This is the point the deposit becomes non-refundable. We scan the microchip number in front of the buyer at pick up to confirm that it is the same puppy they placed a deposit on 2 weeks earlier and to show the new family where the microchip is located for their vet's information.
The deposit can be in the form of cash, Venmo or PayPal. No personal, business or cashiers checks will be accepted at any time. In the event, the buyer is unsure of exactly which puppy they want yet, be advised that the puppy of your choice will be given on a first-come, first-serve basis, in the order of the deposits received. Deposits for the order of picking a puppy can be placed as early as an ultrasound confirms the litter to hold your position of the pick of the litter at five (5) to six (6) weeks after health checks are completed. At that point, you need to know which one you want so the next person waiting to pick can have their choice made as well in a timely manner.
Puppies are available to be picked up from the seller at eight (8) weeks of age. Balance is due in total at the time of pick up. Balance can only be in the form of cash, Venmo or PayPal. No personal, business or cashiers checks will be accepted. A deposit to hold your place for the pick of the litter health checks is refundable within twenty-four (24) hours of notice received of forfeiting your position to pick a puppy at six (6) weeks. Once a deposit is placed on a specific puppy after six (6) weeks, however, that puppy is removed from availability to be purchased by anyone else and therefore, the deposit to hold a SPECIFIC puppy is NON-REFUNDABLE because that puppy is no longer available or shown and is considered “SOLD” with a balance due at pick up at eight (8) weeks.
2. Once a deposit is placed on a specific puppy at 6 weeks of age or older, the puppy is considered “sold”, no longer available to anyone else and the deposit becomes non-refundable, with the following EXCEPTIONS;
If there is a problem with the health of your puppy that falls into the terms and conditions of the accompanying health guarantee that deems the puppy was as “not fit for sale”, by a licensed veterinarian either;
a.) before final payment and pick up by seller’s veterinarian
or
b.) within the said seventy-two (72) hours or three (3) business days, whichever is sooner as per this agreement "grace period" from the date and time of receiving puppy by the buyers licensed veterinarian. In either case, the buyer will have their choice of a full refund or of transferring that deposit toward another puppy from the current litter or order of pick on a future litter. ***Please be certain that you are ready for the time, commitment, and financial responsibility of owning a puppy prior to putting a deposit on one.***
3. The puppy must be picked up once becoming available at eight (8) weeks of age. If the buyer has some good cause such as a schedule conflict with a previous plan, then the Seller will hold the puppy for a buyer for up to seven (7) additional days free of charge provided the buyer communicates that extra time is needed. Any additional time after nine (9) weeks of age will require additional boarding fee charges for; food, vaccines, dewormer, and care. A future agreed-upon date of pick up with the seller will be required and cannot be indefinite.
In the event, the buyer does not communicate that they cannot pick up at eight (8) weeks or simply does not show up to pick up their puppy once it becomes available at eight (8) weeks based on an agreed-upon date and time of pick up per written or verbal communication, via text or email, then communication for other arrangements will need to be made within seven (7) days of the date puppy reaches eight (8) weeks old.
In the event buyer does not make any contact to the seller to make other arrangements and/or does not respond to attempted contact from the seller, within seven (7) days of puppy’s date of becoming available to be picked up, then on the eighth (8th) day of no call/no show/no response to attempted contact, the buyer forfeits the puppy as well as the already non-refundable deposit that secured the puppy to them up to this point.
This scenario would only likely happen in the event of absolutely no communication or response to communication from the expected date of pick up and to the following seven (7) days after. On day eight (8) after the expected date of pick up, if there has still been absolutely no communication at all from the buyer, then the puppy will be made available to another family, and deposit is forfeited with no option of choosing another puppy without showing good cause to prove this wasn't an act of negligence as a new puppy owner.
Good cause would be there was absolutely no way for the buyer to reach the seller by email, text or phone, or respond to sellers' attempts to contact due to an extenuating circumstance beyond buyers' control, such as death, incapacitation or incarceration of a buyer from the point after a deposit is made, but before the point of final payment and pick up. This clause is to ensure this puppy can still legally be placed with another family in a timely manner for the puppy's long term best interest in case of unexpected circumstances.
In the event the buyer does communicate that buyer is unable to complete the purchase by paying the remaining balance due for their puppy at the date of pups eight (8) weeks of age available date, then the seller will give the buyer an “Extention Period” of additional fourteen (14) days total until ten (10) weeks of age to finalize the sale. During this two (2) week period, the seller will give buyer seven (7) day notice via phone or email on day eight (8) of no payment of the balance due that in seven (7) more days, if still unpaid, the buyer then forfeits non-refundable deposit of said puppy and that seller intends to relist puppy up for rehoming.
If after buyer does not have the balance paid in full within fourteen (14) days of puppy becoming available, then on day fifteen (15) all rights and interests in non-refundable deposit as well as in the puppy are forfeited and relinquished. The non-refundable deposit shall be used to further feed, immunize, deworm, and further veterinary care while re-advertising the puppy again most likely for a lower price due to the older age and size. This clause also is to ensure that the puppy is being placed with a family that can afford the health care and maintenance required for a puppy for life.
**Please be certain that you are ready for the time, commitment, and financial responsibility of owning a puppy prior to putting a deposit on one.
One Year Health Guarantee
1. The buyer agrees to have the puppy examined by a licensed veterinarian at buyers expense within the seller’s “grace period” from the time of pick up, failure to do so prevents an established baseline for the health and condition of the puppy with the buyers licensed veterinarian. Not fulfilling this requirement will void this health guarantee portion of this agreement. Proof of buyers' veterinary check must be sent back to the seller via email to [email protected]. Please have your appointment scheduled prior to picking up your puppy to insure this time frame is met and schedule pick up time accordingly.
2. The puppy is health guaranteed according to the terms and conditions of this agreement until 11:59 pm on puppy’s first birthday, against any and all fatal or life-altering congenital defects and/or conditions that adversely affect the health of the puppy. The seller certifies with an accompanying health certificate that, upon buyer receiving the puppy, that it has been physical health checked, by a licensed veterinarian and is in good health, and is fit for sale.
3. This first year of life health guarantee covers the following: any and all congenital defects or conditions including; but not limited to; severe hip or elbow dysplasia (which hampers the puppy's movement and natural gait, and which requires surgery to correct), the spine, and vital organs including but not limited to: the brain, heart, kidneys, liver, lungs, spleen, pancreas, stomach, both the large and small intestines, severe generalized demodex, tracheal atresia, and severe seizure disorder.
4. Seller will not be responsible for any veterinarian bills acquired in the event the buyer decides to treat the above medical conditions instead of immediately returning the puppy.
5. Any health condition that is considered by a licensed veterinarian to be minor, correctable, or a breed-related common condition, other than those listed in this health guarantee is not covered.
6. Any conditions which could go away or are a condition which a puppy will likely grow out of per a licensed veterinarian are not covered.
7. Any conditions caused by an injury or diet after the buyer takes possession are not covered.
8. The seller certifies that the puppy has been immunized and wormed according to the accompanying health record of said puppy.
9. Every effort has been made to ensure that your puppy is as healthy as possible, and they have their heart, lungs, body, bone structure, eyes, teeth, ears, and skin checked by a licensed vet prior to leaving. However, Golden Retrievers and Poodles are prone to multiple health problems that are breed-related. The buyer agrees to accept responsibility for breed-related problems that are not life-threatening and are easily treatable within this (1) year period. 10. Although every measure is taken to protect the health of the puppy, in the event the puppy is found to not be in good health, upon buyer taking physical possession of the puppy at any point during the "grace period" then the buyer is to have puppy’s condition verified by a licensed veterinarian and immediately notify seller from the licensed veterinarian’s office by phone for the seller to speak to the veterinarian for verifying a condition “not healthy for sale” and the reason why. At that point, the seller will retake possession of the puppy provided it is agreeable to both parties and either a full refund or replacement puppy shall be given to the buyer.
11. In the event of the buyer’s veterinarian does not give the puppy a passing health check showing puppy fit for sale, the seller reserves the right to have the puppy re-examined by their own veterinarian at their own expense to confirm buyer’s veterinarian's diagnosis showing puppy was unfit for sale. Any conflict in diagnosis will require a third licensed veterinarian to determine which is diagnosis is the final status of the health condition of the puppy and the cost of any third veterinarian diagnosis will be split between buyer and seller.
12. In the event the puppy is returned under the conditions of this health guarantee, the buyer has two options available from the seller as a remedy: the buyer will receive a full refund on the full purchase amount that the buyer paid for the puppy to the seller and the cost of shipping the puppy back will be at the seller’s expense or
the seller will replace the puppy from either the current litter or another litter when available and return shipping of unhealthy puppy shall be the seller's cost, and shipping of new replacement puppy will be at seller’s cost.
13. No cash refunds are given for any returned puppy that does not have a qualifying condition considered as returnable under this health guarantee.
14. The exemptions to a full refund or return which are not guaranteed or covered in any way to return the puppy or be refunded within the grace period are; any and all conditions caused by injury, any and all conditions caused by neglect, any and all hot/cold temperature related conditions. (For example; heatstroke, exhaustion, dehydration, hypothermia, freezing to death, etc…) NO EXCEPTIONS
15. In the event shipping is required, the cost shall be the burden of the buyer for any and all transportation, crates, dishes, etc… Seller will agree to ship a puppy for buyer provided the transportation method chosen is temperature-controlled ground transportation inside of a vehicle and/or temperature-controlled pet safe cargo airlines such as United unless the outdoor temperatures are considered pleasant for the puppy according to what the pup has been acclimated to prior to shipping. In the event shipping is required, then it is the buyer’s responsibility upon receipt of the puppy to continue to keep a safe temperature and means of adequate hydration for puppy ALWAYS. In the event puppy is found in any type of unhealthy condition immediately upon arrival from shipping, the buyer is to immediately take the puppy to emergency care at the seller’s expense and notify the seller of name, location, and the number of the facility treating the puppy for the emergency condition of the puppy.
16. In the unfortunate event that the puppy does become deceased within this one (1) year guaranteed time frame, and the buyer seeks to be compensated under this guarantee, then the buyer must pay to have the animal autopsied to determine the cause of death. An autopsy report shall be sent to the seller. In the event the cause of death is to be found to be one of the above health guaranteed covered conditions, the seller reserves the right to a second veterinarian opinion if the seller feels it is necessary, to determine the cause of death to be confirmed at the seller’s own expense before refunding the buyer. In the event, both veterinarians conclude the same cause of death that is from a congenital health condition covered in this health guarantee, and the buyer chooses the option of a full refund of the purchase price, then the seller has up to thirty 30 days maximum to refund the buyer the cost of the puppy.
17. Puppies are guaranteed for one year from the date of birth. In the event a puppy is found to have a covered congenital health condition that warrants its return, the buyers licensed veterinarian must send a certified letter that’s signed and dated with the said non-treatable defects/illness. The letter must come from a licensed veterinarian and include the veterinarian’s name, address, and telephone number. The scenario is unlikely since we do multiple health checks before purchase and the buyer also does one within the "grace period" after receiving the puppy, so if something does arise, which it still could, then this is the first step to resolving it through this guarantee.
** NOTE: Parvo survives in soil for up to one (1) year. The buyer should heed these warnings of risks of unknown ground conditions with all extreme caution as the seller does. However, it is out of seller’s control if the buyer does, in fact, place puppy on contaminated soil, therefore seller cannot be responsible past the "grace period" of any and all communicable diseases such as flu, parvo, distemper, etc... because the puppy has been with the seller for a minimum of 8 weeks and has been deemed healthy at departure and 14 days minimum after the first vaccination.
Health Guarantee is valid one (1) year from the date of signing until 11:59 pm of that same day of the following year or until 11:59 pm of the date that the puppy reaches one (1) year of age, whichever comes first. One Year Health Guarantee is intended to cover through the completion of the first year of life, covering any health issues that are congenital/genetic conditions that are due to the breeding of these specific parents and not intended to cover “common conditions” known in the breeds that the owner should be aware of prior to choosing the breed; unless the “common condition” is severe, disabling and/or life-threatening.
Seller Responsibilities
1. It will be up to, the seller, to decide when the puppy is ready to go to its new home. The expectation is at the age of eight (8) weeks, per the laws of the State of Missouri, that is the youngest puppy may leave. Other considerations include; proper socialization with mother and littermates to determine sound temperament, and at least one vaccination minimum which depending on the health and weight of the puppy are administered to the litter at six (6) weeks of age. We will not, under any circumstances, let the puppy leave before it is fully ready and ten (10) days have passed since its first shots.
2. The puppy will be up to date on puppy shots and worming at the time of pick-up of the puppy. It is very important that you continue the vaccinations and worming. (Please do not expose your puppy to other animals that are not vaccinated or place them on the ground in public areas until he/she has completed the entire vaccination schedule - around 16-20 weeks old.) Seller is not responsible for preventable diseases acquired after buyers health check within the aforementioned "grace period" of receiving the puppy, Puppy has received a minimum of one 5-way puppy vaccine by 6 weeks of age and within every 3 weeks thereafter until puppy vaccinations are complete or puppy has been placed with the buyer. Puppy has been dewormed minimum of one by two (2) weeks of age and within every two (2) weeks thereafter until is four (4) months or has been placed with the buyer.
3. The puppy will have been veterinarian health checked within ten (10) days prior of the sale to a buyer and deemed in good health with no congenital defects or a heart murmur, no apparent/visual bone structural deformities, no apparent/visual skin, eye or mouth conditions, and no apparent/visual topical or internal parasites. This health guarantee does not cover or include minor health illnesses, such as colds, allergies, internal or external parasites or hernias after the date and time that the puppy is in the buyer's possession and deemed healthy by both buyer and seller’s veterinarian’s within “grace period” as per this agreement.
4. The seller will disclose whether the puppy has had any pre-existing illnesses or health issues prior to the sale and/or any pre-existing conditions (such as umbilical hernia) which will have been treated by the seller’s veterinarian and puppy deemed healthy prior to selling. The seller assumes no responsibility for any medical expenses incurred after the buyer takes possession of the puppy.
5. The seller is not responsible for puppies which develop hypoglycemia after the puppy is in the buyer's possession. The buyer will receive information on what to do if this occurs at this website https://www.thesprucepets.com/low-blood-sugar-in-puppies-2804768. Please be familiar with the causes and symptoms of this common condition prior to taking your puppy home to prevent drops in blood sugar levels.
6. The seller is only responsible for its own environment of the puppy. Seller does not assume responsibility for this puppy’s environment and exposures immediately upon buyer taking possession of the puppy and leaving the seller’s presence with the puppy. It is the responsibility of the buyer to care for the puppy properly and keep it free from harm. Please remember that your puppy must be treated with great care and protected from any and all danger. Examples of this are ingesting toxic substances, small choking hazards, chemical hazards, vehicles, strangling hazards, electrical hazards, etc… This is a new life and should be cared for accordingly.
7. No sections in part or in the entirety of this health guarantee cover any health issues caused by injury and/or neglect at any point, starting immediately upon buyer taking possession of the puppy and leaving the sellers' presence with the puppy. If any injury should occur with the shipper while in transport, then the liability is to the shipper, not the breeder.
8. The seller assumes no responsibility for training difficulties or behavior problems developed after fourteen (14) days that were not present or apparent within the first week of the arrival of the new puppy. The buyer should not have any problem with the training process provided exercise is given along with time and effort made. The learning curve varies from puppy to puppy, so always be consistent to speed up the process and be educated in advance to the nature of the breed of puppy selected to meet exercise and stimulation needs as well as the nature of the breed and the best training methods. If there was a behavior problem prior to leaving, the seller would offer a different puppy or extend the pick-up time in order to work with the puppy individually to address and correct any problems.
9. The seller does not guarantee weight, height, fur color, or texture. We can give the buyer the height, weight, color, and texture of the puppy’s parents and of other puppies out of that mating and thereby giving the buyer an educated guess as to full-grown height, weight, color, and texture, but there are too many variables besides genetics that can affect height and weight, and even coat, such as diet. Color and texture continuously change and any speculation to final coat color is purely from opinion based on previous litters and experience but not guaranteed in any way and can be altered by grooming choices.
10. The seller does not automatically give, nor restrict breeding rights, nor guarantee fertility, nor the ability to place in canine shows or sporting events. The puppy is strictly sold as a TOP QUALITY PET AND/OR WORKING DOG.
11. In the event of the buyer is purchasing a puppy with no restrictions on breeding, such as a non-registered Goldendoodle, the seller requires that buyer only breeds the dog upon completion of puberty at full maturity of bone mass and growth approximately around 18 to 24 months usually. The seller recommends buyer waits until completion of all health clearances of at a minimum, preliminary initial health clearances for hips, elbows, heart and eyes, being these are common conditions in Golden Retrievers and Poodles.
12. In the event the buyer desires to spay or neuter their puppy, the seller requests that the buyer wait until full maturity of puppy is acquired by being full-grown at approximately eighteen (18) months to two (2) years of age. This is due to studies from U.C. Davis, California Veterinary Hospital showing a 5-7% increase of risks and occurrences of hip dysplasia, in Golden Retrievers specifically, in connection with early spay and neuter. S*x hormones through puberty are necessary for full bone density.
The exceptions to this would be if other good cause circumstances that outweigh this risk are present in individual buyers' personal circumstances and should be discussed with the seller. 13. In the event the puppy is returned within the first thirty (30) days of the date of purchase, for any other reason than the above mentioned covered reason of being deemed unhealthy, unfit for sale, within the “grace period”, then only half (½) of the purchase price will be refunded.
The refundable half (½) of the purchase price will be sent to the buyer within seven (7) days of the puppy being rehomed to his/her new home, but not before the puppy has been rehomed. The other half (½) of the purchase price shall be retained by the seller in order to cover the cost of re-advertisement, feeding, and keeping the puppy current on vaccinations, wormings, and veterinarian care until the puppy is placed in his/her new home.
Additionally, any returned puppy will have to be quarantined for a period of ten (10) days prior to rehoming, in order for the seller to guarantee that the puppy has not contracted any communicable infectious diseases that incubate within four to nine (4-9) days so the seller knows the puppy is indeed healthy and fit for sale before rehoming.
Again, be aware that there is a ten (10) day period of quarantine on a returned puppy and that if the puppy is healthy at day ten (10) then the puppy is available for a new home and the refund half (½) of the purchase price can be processed when rehoming is complete. In the event the puppy is not healthy, it cannot be rehomed until it is.
In the event that the puppy becomes deceased due to communicable disease during said ten (10) days quarantine, then no amount of refund shall be returned to the buyer. It shall be presumed the buyer was aware of the condition prior to returning the puppy to the seller.
14. In the event puppy is returned anytime after thirty (30) days from the date of the buyer receiving puppy, no money will be refunded.
Buyer Responsibilities
1. The buyer agrees to take excellent care of this puppy, by providing appropriate housing in a clean, climate-controlled environment, provide vaccinations, worming, heartworm prevention, proper socialization, veterinarian care, consistent daily food schedule, ALWAYS a constant supply of fresh water AND by feeding high-quality food for large breed puppy, formulated for all stages of life and according to keeping the Body Condition Score 4/9, to keep bone structure forming correctly during growth and after healthy. Additionally, small treats with no additional calcium to protect legs from deforming.
Dietary recommendations for large breed puppies:
1. Make sure the diet is complete and balanced for “all life stages” according to AAFCO guidelines, or if homemade, has been analyzed by a veterinary nutritionist.
2. Diets that have been tested in feeding trials are preferred to those that have been formulated according to AAFCO guidelines only.
3. Never free feed.
4. Keep the puppy lean (4/9 or 5/9). 5. Look for these guidelines: (a.) A dry matter content of about 30% protein, 9% fat, 1.5% calcium and 0.8% to 1% phosphorus. (b). The calcium: phosphorus ratio should be between 1:1 to 1.3
2. The buyer agrees to house the puppy properly according to outdoor daily temperatures, heat index, and humidity levels. Not to be left outdoors for any long period above 90 degrees or below forty (40). Igloo puppy houses are not proper housing in winter months in regions that temperatures drop below forty (40) degrees. Buyer further agrees to not leave a collar on the puppy when the puppy is not in owners' vision such as when being crated to prevent the collar from catching on something and causing the puppy to strangle. Seller recommends a harness only and nothing around the throat of any pets ever for their safety due to past experiences of grief and loss in this manner.
3. Buyer agrees to maintain shots according to the laws of their local town and control the puppy on a harness when in public, (meaning outside of their own fence or house), at all times with the exception of a fenced-in or designated, dog play area, or another person’s fenced in yard or home. It is the buyer’s responsibility to continue with vaccinations and deworming of the puppy after they are placed with the buyer. Incubation for Parvo is 4-9 days. Therefore, it is the buyers' responsibility to keep puppy off of public places that other animals have been until three (3) weeks after vaccinations are complete at approximately sixteen to twenty (16-20) weeks of age. In the event buyer places a puppy on contaminated soil after leaving the seller, the puppy could acquire parvo from that single event as early as day 4 of arrival to the new home due to the incubation period. This is the purpose of the guarantee only covering just the first seventy-two (72) hours of leaving sellers home and requiring a veterinarian health check within that time frame, in order to not be held liable for any doing caused by buyers choices of environment and belief of areas being safe after departing from sellers presence. ***No replacement will be offered in the event puppy acquires Parvo after the “grace period” of leaving seller***
4. Buyer agrees NOT to sell this puppy to any retail company or establishment such as pet stores or online sites. This contract is legal and binding and may be enforced by legal means at the buyer’s expense. Any and all disputes are agreed to be settled in the State of Missouri according to Missouri State Laws.
5. This puppy is sold to you as a top-quality pet only. There are no breeding rights given or implied, nor are they restricted, if your AKC papers are marked full registration such as a purebred Golden Retriever, or the breed is a non-registered breed such as a Goldendoodle. However, In the event buyer purchases the puppy with the intention to breed their pet, with the understanding that there is no implied guarantee of the ability to produce, then it shall be with the agreed upon, in this written clause that there is an understanding that***this puppy is not to be used for any type of puppy mill, puppy farm or other mass-producing operation*** and may only be bred with reputable breeding practices.
Reputable breeding that meets AKC and State Kennel standards for hobby breeders is not considered mass-producing. However, any breeder with ten (10) or more breeding dogs is considered mass production. If full registration is purchased which gives the buyer breeding and showing rights, it is with the written and signed agreement of this document that this puppy only is bred by either private (4 or less intact puppies) or hobby breeders (5-9 intact puppies) who are focused on improving the standards of the breed. This is to clarify that although the buyer may have the right to breed the puppy at a certain point, they do not have the right to breed it in a mass-production environment to ensure that no puppy mills purchase a puppy from this seller and if they do that they know they are in breach of this agreement.
6. The buyer further agrees that the puppy will NEVER participate in any type of academic studies with any facility with IACUC animal testing, nor participate in clinical trials testing with experimental drugs, nor participate in any type of university lab testing of animals or any other type of facility with any similar activities that risk harm to the animals tested on. This is non-negotiable. The only lab work to be performed on this puppy is to be for his or her own personal canine care requested by his or her personal licensed veterinarian, for his or her own personal health care. There are no exceptions to any type of testing or experiments that could be deemed cruelty to animals.
7. The buyer agrees to never abandon or surrender the puppy to an animal shelter, rescue group, or other similar facilities, without at least first attempting to contact the seller to make other arrangements for the puppy to return to the seller as previously stated in this purchase section of this contract.
8. The buyer agrees that this health guarantee applies to the original buyer only and cannot be transferred to a second buyer or owner without consent from the seller. In the event, the buyer is unable to keep the puppy after purchase, for any reason, the buyer agrees to return the puppy to the seller if negotiable between the two parties. Buyer agrees to not place the puppy in another home without attempting to first contact the seller for an attempt negotiating the best outcome and unless consent is given by the seller that the buyer's alternative option for a home is the best option given whatever are the extenuating circumstances bringing this situation about. Seller requires this in order to place new owners under the same terms and conditions as the original buyers for the health, safety, best interest, and protection of the puppy.
9. The buyer agrees that in the event shipping is required, any costs related to the shipping of puppy from the seller to the buyer are buyer’s cost, including any crate, water, and food dish required by shipper. Additionally, the choice of shipping method and carrier is chosen by the buyer that meets the seller’s previously stated conditions. The seller is not liable for the puppy once placed in the hands of the shipper, due to the shipper is liable and inspects the puppy is in good health upon receipt and is given a certificate of health from a licensed vet as required in order to ship a live animal across any state lines.
10. The buyer agrees that any and all disputes that cannot be settled between buyer and seller according to the terms and conditions of this purchase agreement and health guarantee that require mediation, arbitration or court filings, must be filed in the State of Missouri at Greene County Courthouse, where seller resides, at buyers expense.
11. Buyer agrees that any changes to this purchase agreement or health guarantee must be agreed to in writing and signed by both parties.
12. Buyer agrees that this is a legally binding document. In the event of legal action, the buyer will assume all legal costs including, but not limited to, seller’s attorney’s fees and legal costs in the event that the final disposition of any mediation, arbitration or court rules in favor of the seller and the Seller agrees to the same conditions if final disposition is ruled in favor of the buyer.
