F.A.C.T. (Fireworks Action Campaign Team) F.A.C.T. was formed to raise awareness of the escalation of INDISCRIMINATE and UNLAWFUL use of fireworks.

F.A.C.T is a non-profit organisation, founded by a group of concerned citizens on the South Coast of Kwazulu Natal in South Africa. Year after year their community is faced with the devastating aftermath of celebrations where fireworks are used recklessly with no regard for nature. Wild and domestic animals are left traumatized or at times killed and the widespread use of so called "BIG BANG" fire

works is making the situation much worse. These concerned individuals took it upon themselves to raise public awareness for the INDISCRIMINATE and UNLAWFUL use of fireworks and educate the public on safe, responsible practises. We hope to gain your support in keeping our animals safe...

THE EXPLOSIVES ACT No 26 OF 1956
This law applies nationwide with no exceptions. It is unlawful to discharge any firework in any building, on any public thoroughfare or in any public place or resort without prior written permission of the local authority. (Section 10.34)

Section 10.35 relates to public displays of fireworks and states that no person may do so on any premises without the written permission of the Chief Inspector of Explosives (commonly known as “having a permit”). This written permission will stipulate conditions and any non-compliance with them is a criminal offence.

In terms of the Explosives Act, no person shall allow or permit any children under the age of 16 to handle or use fireworks except under the supervision of an adult person.

This Act is enforced by the South African Police Service (SAPS) not by the SPCA. Please report any offences to your nearest SAPS, giving as many details as you possibly can and quoting the Act name and number plus the relevant section as given above.

RESIDENTS URGED TO ADHERE TO CITY'S FIREWORKS BY-LAWS

EThekwini Municipality appeals to residents to use fireworks responsibly on New Year's Eve and to be mindful of the impact fireworks have on animals.

Residents are reminded that the use of fireworks on New Year's Eve is only permitted between 23:45pm and 00:15am.

By-laws are in place to govern the lighting of fireworks. Fines will be issued if anyone is in contravention of them. According to the City By-Laws, fireworks must be restricted to a person’s property and may not be lit on a public road.

Residents could face fines up to R3 500 as an admission of guilt. The fine for discharging fireworks on the road is R1 000, and the fine for discharging of fireworks in public is R2 500.

The use of low-hazard fireworks such as fountains, lawn lights, and sparkles are permitted in private homes. Fireworks such as air bombs, supersonic bangs, sound shells, fountain whistles, and screeches are prohibited as they cause a disturbance and are a nuisance to neighbours.

The public must note the following:
• By-laws also call for children under 16 years to be properly supervised by an adult when using fireworks.

• Fireworks should be detonated away from hospitals, clinics, old age/nursing homes, animal welfare organisations, and petrol stations. Fireworks should not be pointed towards any person as this is dangerous.

• No person shall ignite, discharge, or explode any fireworks on any public road, residence, or private dwelling without the knowledge and consent of the occupant or owner of the property.

• It is unlawful for any person to point or direct a firework at any person, animal, building, or motor vehicle where such firework is in the process of exploding or detonating.

• No person shall light or detonate fireworks in any place where animals are kept.

• No person may terrify, cause stress, or endanger the life of any animal with fireworks or by any other means.

• Residents are also reminded that fireworks cannot be recycled and therefore must be disposed appropriately in black bin bags.

The Municipality urges residents not to dispose fireworks in orange refuse bags because they are not recyclable.

Residents found disregarding the by-laws governing firework usage shall face the full might of the law.

RESIDENTS URGED TO ENGAGE IN PEACEFUL NEW YEARS CELEBRATIONS
The eThekwini Municipality appeals to residents to distance themselves from the discharging of fireworks to celebrate the New Year and instead, light a candle in their homes.
Following the address by President Cyril Ramaphosa on 29 December, Metro Police Senior Superintendent, Parboo Sewpersad said: “We urge residents to hold peaceful celebrations to bring in 2021, by lighting a candle in their homes as a tribute to those lives lost as a result of the current Covid-19 pandemic, and to also acknowledge the contribution by frontline workers.”
Sewpersad added that if residents are engaged in the discharging of fireworks, they must do so in a responsible manner, taking into consideration the health and safety of their furry family members. Pets must be kept away from the fireworks and must have an identification tag with the details of the owner, including their home address and contact number.
Fireworks are allowed only on New Year’s Eve, from 23:45pm to 00:15am. Bylaws are in place that govern the lighting of fireworks and fines will be issued if anyone is caught in contravention. Fireworks must be restricted to a person’s property and not be lit on a public road.

Superintendent Sewpersad concluded that the Durban Metro Police have been inundated with calls and complaints with regards to the defiance of some residents in Queensburgh, regarding their discharging of fireworks on a public roadway. “We have the full support of the National Prosecuting Authority in bringing such culprits to book. They will face the full might of the law. This applies to residents in all areas of the City as well.”

How to keep your pets safe during the fireworks season:
• Keep them indoors in a familiar room
• Close the windows and curtains
• Have the TV or radio on to muffle the sound
• Stay in the room with them and act normally, our pets react to our emotions, so if you are calm, they will feel calm
• Give them something to do, such as a chewy bone to munch on or catnip toys for cats
• Get a herbal calming medication for your pet (most effective when started a week prior to the expected fireworks, available to purchase at your local SPCA or Vet)
• Have them microchipped

Please make the SPCA your first port of call should you find a lost or stray animal or if you have lost your pet. Animals are kept at the SPCA for 7 days before they are put up for adoption. If your pet has gone missing, please ensure to visit your local SPCA’s within the 7 day timeframe.

As I get ready to go home on old year’s eve after another 16 hour shift, I am faced with some trembling little people who are petrified and won’t let me leave. We try and calm them down and reassure them that it’s simply fireworks to celebrate the New Year. Looking at these little humans I realize just how deep their trauma still is and how quickly certain memories still trigger and remind them of a life once led, a reminder of the harsh world they came from, where guns, drugs, abuse and hunger was what they knew and grew up with. Our autistic little person is totally out of control and starts screaming, I try and understand the noise in her head, I can’t – I simply hold her and try and calm her down. The others run and I find two under my desk…the safe place they have accepted as their own. Little people your fight has been so long and so hard and you have crossed so many hurdles, but tonight I realize we still have a long road ahead and what is simple normal everyday reality moments for us is your trauma memories, the memories you try so hard to forget. Slowly we will help you work through them. No matter what you will always be our special little people. Tonight we will leave all the lights on because we understand your fears. We pray 2020 will be a better year for you and slowly you will find peace."
