The Bloemfontein SPCA continues to see an influx of members of the public having tortoises in their possession. The keeping, selling or trading of these gentle slow moving creatures is highly illegal and should you be caught you could face a number of charges under the Animals Protection Act and The Free State Nature Conservation Ordinance.

The fines set out in these legislations can include imprisonment of 10 years and/or fines of up to R100000. The Bloemfontein SPCA continues to be vigilant in our attempt to preserve our indigenous wildlife.

This was the case when the Bloemfontein SPCA received a call from a concerned member of the public stating that 4 individuals were transporting a tortious inside the boot of their vehicle. The vehicle was tracked down at a nearby shopping centre and the tortoise was taken into the possession of the Bloemfontein SPCA.

Allegedly the individuals picked up the tortious for safekeeping as it was on the road. However, there will always be a difference of opinion. To prosecute for any offence in terms of criminal law the state must prove its case without a reasonable doubt during trial. This often leads to difficulty in the conviction process and often limits the effectiveness that can be formed from prosecution.

The occupants were issued a warning and were made fully aware of the fines and jail time they could face.
